Graham Family Lies Build Up

The murder trial of Hershel Dale Graham enters it fourth day this morning. Graham is being tried for the Felony Murder of David Martin Andrasik. Testimony yesterday provided some dramatic differences in witness statements and statements by Graham at the time of the shooting. Let's look at some of them.

Hershel Graham: He retrieved his handgun when his son Elijah and girlfriend Cassidy ran into the home to tell him an angry man was outside and wouldn't leave.

Holly Lewey (Red Bay School Teacher): Graham came outside, talked with Andrasik, returned to the home and came back out with the weapon.

Hershel Graham: Andrasik refused to leave.

Holly Lewey: David attempted to leave, but was called back by Elijah Graham who removed his shirt and stated he was prepared to fight.

Hershel Graham: Andrasik verbally threatened him.

Holly Lewey: David said nothing before he was shot.

Hershel Graham: Andrasik charged at him and he shot.

Holly Lewey: Hershel Graham simply raised the gun and shot David from approximately three feet away.

Hershel Graham has four attorneys representing him in his bid to beat the Felony Murder charge. A friend was in court yesterday and reports that most of their defense during morning testimony relied on red herrings:

...Graham is being called disabled. He looks like a beached whale. He could just fall on someone and kill them. The attys have made fun of the ABI's lack of recording devices. Seems they used a cell phone that didn't work. They've also brought up drugs they know the state can't or didn't test for. Looks like if Mr. Andrasik had been taking these drugs along with drinking he would have been dead ages ago. They must have hoped the jury didn't know the purpose of anabolic steroids, cause I've never seen a pic of Andrasik where he looked even slightly muscular...didn't see Elijah or the grandfather in court. Guessing Elijah will have to testify, maybe g.father also.

Elijah Graham, son of Hershel, is expected to testify for the defense today. He is currently under indictment for drug charges in Franklin County. He has taken to Facebook to announce that no one but God can judge him. We had found this a nebulous statement until it was revealed that it was he who called David Andrasik back to his death. Elijah must feel great guilt that his father is now in danger of spending his remaining days in lockup.

  2. From what I've read so far it would seem a jury would have no option but to convict. Is manslaughter on the table?

    1. That we don't know. It might also depend if Carla Andrasik is willing to let Graham plead to it. If he did try for a plea, we're pretty sure they would try for 10 years and get good time.

      Sad all the way around, but no one made Hershel Graham shoot David.

  3. Hopefully the jury is smart enough to listen to the teachers accounts of what happened and realize graham is a liar. God let there be justice for his wife, children and family.

  5. Once again, this trash blog has tried to sway public opinion before a defense has even been presented. With a headline like "Graham family lies build up" the authors are attempting to convict before evidence is presented. If this had been the first time it may be dismissed, this is a pattern for Shoalanda Speaks and hopefully someone someday will have enough fortitude to sue the LLC for libel.

In order to sue for libel, Graham would have to prove he told the truth while the respected Red Bay school teacher lied, a woman who knew neither man but who just happened to come upon the scene and call 911. Yes, she called, not Graham who shot David and walked back in the house and began watching the movie he had left earlier. Nice guy, huh?

    2. Like the teacher I know neither man, but like most in the area am sick and tired of seeing this blog present opinion and gossip as truth, especially in murder trials. And it might interest Shoalanda to read the blood alcohol level of Andrasik at the time of his death. There are always two sides to a story, not just "opinion" that is what the courts are for, not swaying the court of public opinion

    3. We're aware of the BAC for Mr. Andrasik. According to those in court, Graham had also been drinking, but no one bothered to test him. The prosecution is presenting evidence that David was too intoxicated to hurt anyone. We think DA Joey Rushing knows what he's doing.

  6. You can never predict what a jury will do. I'd say guilty, but he may get off.

  7. First off, this country could have more Blogs such as “Shoalanda Speaks”, who informs us of the truth, when many are afraid to do so. Second, my prayers go out to the family of David Andrasik, and I believe that God will ensure that this jury follows the laws of the State of Alabama and finds Hershel Graham guilty of murder, there was NO SELF-DEFENSE here. Andrasik was unarmed, tried to leave when Elijah Graham “went after him, ripping off his shirt to fight Andrasik”. Isn’t he the aggressor? And one would think with the indictment Elijah now has against him for drugs, his words aren’t to be trusted, but yet, he wants to jury to believe him against a dead man that cannot speak for himself. And to the “theavenger” what does the blood alcohol level of the dead man have to do with anything? When one is impaired, they cannot defend themselves, correct? In mine and so many others opinions, nothing more than an excuse for Graham to take the opportunity to put a bullet in David Andrasik’s heart without him knowing it was coming. He had no chance to ever defend himself. That was one of the most ignorant statements I’ve heard. But your “name” tells us much. And, did you also know that neither Graham, nor his son were tested for alcohol or drugs…so we will never know now will we? So, before you cast your uninformed nonsense, you may wish you get your facts straight. Obviously, you are a friend or family member of the Grahams. To the comments about Graham’s appearance, “huge” difference from the night he murdered David Andrasik. Yes, he was heavy then, but not too heavy to gun down an innocent man, and there was no walker either, this is a feeble attempt to sway the jury, a tactic used often by attorneys to their clients. At least he can walk; Mr. Andrasik is in his grave, never to walk again. Another few well known facts about Andrasik, are that yes, he was “at one time” a black-belt in karate, as a teenager and in his very early 20’s, he was 42 years old when he was murdered, just Google or asks those who knew him. When in karate he was a young man in search of a way to demonstrate self-discipline and engage in a healthy life-style. Taught young and old alike, but the young mostly to teach respect, not only for themselves but for the community in which they live. Discipline and respect are the key words, not violence. Yes, he competed within the realms of the karate environment on a very limited basis, not to harm, not to fight, but for skill of self-control and a healthy mind, no different than those who now days do yoga or work out at a gym. So to ever say that “they” knew he did karate and was dangerous is a totally fabricated lie, one of many against a man who cannot speak for himself.

    Now to the Borden witness. She “was afraid”; she sure made a lot of phone calls all during this time, but none to 911. And why, if so afraid of an unarmed man, did she come back out of the Graham’s home??? Because she knew that Graham had a gun on him? Something to think about, her credibility is non-existence and her lies will stay with her for the rest of her life, wait until any prospective employer learns of her lies, she has damaged her future. You are who you associate with, correct? No one wants Graham’s case to be what some call a lesson to others, but it should be looked upon as a murder of a defenseless human being, with a wife, children and other family members who, though live out of state, love and miss Mr. Andrasik more than anyone could ever imagine. We must pray that this jury finds him GUILTY, as these types of murders are happening all too often in this country, even of innocent children, and elderly. It could happen to anyone out there. Neither Graham nor those who were with him, was ever in any danger, a quick call to 911 would have saved Andrasik’s life. It’s time this country puts a stop to senseless murders and stop allowing the use of “self-defense” as a ridiculous reason to allow a murderer to go free. Please remember, Andrasik has no one but an honest and knowledgeable DA, Joey Rushing to speak for him as he has had 16 months to compile the truth, and God Bless the jury for listening to the truth and obeying the laws of the State of Alabama and find Graham guilty. Mr. Andrasik can no longer speak to defend himself. He was silenced by a bullet to his heart.
