Anyone Ever Make It to Court in Franklin County?

The trial of former Vina teacher Kimberly Bynum was postponed again. Counting pre-trial delays, we're not sure if this was postponement number six or seven, but her original arrest was in June 2011. For those who have asked, a speedy trial is the right of the defendant, not the state. Still, isn't it better to just go ahead and get it over with? The facts of the case won't magically disappear, or will they? Several readers have suggested Bynum may still marry her former student. Well...perhaps the Franklin County Jail could add a honeymoon suite?

We're also waiting for the murder trials of Hershel Graham and Jason Green. Green's trial has been postponed once and was scheduled for the first week in February. The families of David Andrasik and Shay Ledlow need closure, not more delays. Still, we hope for strong convictions in both these cases; any refusal of a delay could possibly be used in an appeal, and the families do not deserve the stress of yet a second trial.

Justice Delayed in Franklin County?

The Franklin County trial of former Vina teacher Kimberly Bynum has been delayed for the fifth time; her new day in court is scheduled December 10th. The relative newness of the sex charge against Bynum may be behind the delays, but those affected by Bynum's case certainly wish for the proceedings to take place as quickly as possible. Similarly, the Felony Murder trial of Hershel Dale Graham, also in Franklin County, has been postponed for the fourth time. We're not sure who holds the record for the longest string of postponements--Tommy Arthur or Tre' Wells or someone else, but we hope Graham's attorneys don't come close to breaking the record.

Franklin County Follies: Bynum & Common

Vina High School

After two postponements, Kimberly Bynum, 30, will face a jury trial beginning October 15th in Franklin County. She will become the first local teacher tried under the 2010 law that makes consensual sex between a teacher and a student under the age of 19 illegal. The former Vina High math teacher was arrested in June 2011.

J.J. Common has reportedly turned down a 25 year sentence plea deal offered by Franklin County. Common faces a distribution charge in Franklin, as well as federal probation violation charges, as well as...well, we've lost count. Common has reportedly fired the attorney who advised him to take the plea and hired Daryl W. Moon of Florence to defend him at trial.

Common allegedly feels the police video of a drug deal could feature almost any black male wearing a baseball cap and hoodie. After all, it is such popular attire in some circles.

Kimberly Bynum/Such a Hot Button

Amanda Watkins and Dana Allen have hit the dust, up next is Kimberly Bynum. All three are married women who admitted to affairs with teenagers. Watkins and Bynum are teachers, while Allen was a volunteer coach. The sexual encounters of Watkins and Allen fall under the category of Second Degree Rape, while Bynum's crime is relatively new territory.

It's illegal in Alabama for a teacher to have sex with a current student under the age of 19. In the first 12 months after the law was enacted on July 1, 2010, six teachers were charged. Previously, these six would have faced only charges of contributing to the delinquency of a minor.

Bynum's attorney has had his client's day in court postponed twice. While some prosecutors claim the crime is comparable with incest, teacher advocates deem it simply a breach of trust that should result only in the loss of teaching license. It will be extremely interesting to learn what Joey Rushing may or may not offer the former Vina teacher.

Would it surprise you to find out that not only do I own an AR15 myself, by my wife owns an AR15?, too  We have dozens of 'high-capacity' magazines and thousands of rounds of ammo for them. BTW....hers is PINK. :D

* Americans have NO NEED for cars and motorcycles that can exceed 75 mph, yet my Titan truck shows 140mph on the speedometer and many of today's motorcycles can EXCEED 160mph.

Dana Myhan Allen: Avoiding a Trial

Dana LaShana Myhan Allen has accepted a plea agreement that may or may not keep her out of prison. Let's look at some facts in the case of this married basketball coach:

1. "The boy will brag about it all his life." Really? If he's 14 or 44, it's still adultery. Bragging about that doesn't say much for him.

2. Why just the one charge? The other youths with whom Myhan allegedly had sex were over 16, the age of legal consent in Alabama.

3. Why the plea? A trial might have resulted in the others youths testifying against Myhan. Also, if convicted by a jury, the judge would have control over her ultimate sentence (he still does, but would have to provide a valid excuse for failing to accept a plea that both sides had agreed on).

4. Why only 36 months? Didn't Amanda Watkins get five years on two counts? Watkins was convicted by a jury. She was also a teacher; Myhan was only a volunteer coach at Wilson High School. Plus, different counties and different prosecutors were involved, making too many variables for the sentence to have been the same.

5. Will she get probation? That will also ultimately be up to Judge Jones. We predict she won't.

6. After conviction, will she get to see her underage children? Since this was Second Degree Rape and no forcible sexual molestation took place, there should be no problem with her having contact with any children whether her own or others.

7. Why even call it rape? Many object to this term, yet the consentual sex between an adult and a child under 12 qualifies as First Degree Rape. The word "rape" seems to have taken on more narrow connotations to some, just as "molest" has. We receive frequent reports of dogs molesting walkers in all areas of the Shoals, just not sexually we hope.

8. Isn't she really innocent since she had a "mental defect?" Everyone has some mental defect. Your next door neighbor may harbor an unreasonable fear of snakes or your best friend avoid escalators at all costs--that fact does not prevent them from knowing right from wrong, whether the crime is rape or murder.

Now Allen and her victim(s) wait for July 26th when she'll face her sentencing. We'll also learn at that time if she will be eligible for any early release programs. We don't envy Judge Jones these decisions.

The June court appearance of Kimberly Dawn Bynum has been postponed again. Bynum is accused of having consentual sex with a student under the age of 19. This month marks one year that the 30 year-old Vina teacher's life has been in limbo due to legal charges. The guilty verdicts and pleas of others in similar cases do not bode well for this former Franklin County teacher.

Dating in Florence: Fuggetaboutit?

The Florence metropolitan area has been listed as number nine in the ten worst places for singles to live in the U.S. Is this surprising?

Over the years, we've seen many young people either remain in or return to the Shoals due to family crises. These Shoals natives, assuming they wish to date, can usually only find singles in what is commonly called the working class. So, you either marry down or you don't marry at all. If you don't marry, you don't reproduce (usually). The genes of these Shoals citizens with above average intelligence aren't passed on. Think about it...it doesn't take a border collie.

Because of a murder trial in Franklin County, another big case headed to trial had to be delayed.

Jury selection was supposed to begin for Kimberly Bynum Monday.

She's a Franklin County teacher accused of having an affair with a 17-year-old.

Bynum was arrested last summer. Her trial is set to begin June 11th.

We doubt that Kimberly Bynum is eager for her trial to begin; however, until her legal problems are adjudicated, she has only slim hopes of getting on with her life and obtaining a decent job. We've asked several individuals how Ms. Bynum is supporting herself, but so far we've not received any definitive answers. 

Franklin County juries usually render much harsher verdicts than those in Colbert or Lauderdale. After the verdict and sentencing of Amanda Duboise Watkins, we infer Kimberly Bynum's prospects don't look good.

Hershel Graham/ Kimberly Bynum Court Updates

Hershel Graham waived his right to an arraignment last Friday and pleaded not guilty to the murder of David Martin Andrasik. His trial is scheduled for later this summer. It seems unlikely that Franklin County will pursue related charges against Graham's son Elijah, who has publicly announced he will be leaving Franklin County as soon as he is able to do so.

A March 21st pre-trial for Kimberly Bynum has been continued. Her Franklin County trial is still presumed to be scheduled for this summer. After the verdict in the Amanda Duboise Watkins case, we may assume Bynum's attorney is being exceedingly vigilant in preparing for her case related to admitted sexual misconduct.

We are still receiving reports that Bynum has married, but have been unable to verify this. If anyone can provide us with documentation, please do so. This could greatly impact her trial.

Amanda Watkins to do Mandatory 10 Years

Colbert County Judge Jackie Hatcher yesterday sentenced Amanda Duboise Watkins to two mandatory five year terms to be served consecutively. If Watkins should experience any trouble in prison, she will be forced to serve the entire 20 years--not a pleasant thought.

This sentence doesn't bode well for Kimberly Bynum of Franklin County and Dana Allen of Lauderdale. These two women face similar charges and ostensibly similar sentences should they be convicted.

Bailey's Bailiwick: Just Say No to Teacher Sex

When I was a small child we had a neighbor, Mrs. Dollie Smith (I've changed her last name). Miss Dollie as most people called her was a widow with several grown children. Miss Dollie always had a neat yard and was known for serving the Lord.

At some some point when I was in school at Richards Elementary, Miss Dollie's daughter and son-in-law had to leave for military duty or some similar reason. Their two children came to live with her. These girls were older than I, but sometimes my mother would drop them off at Coffee High before taking me on to Richards. They were both very nice and polite. One of them even once chided me for sassing my mother.

Some months ago, a friend asked me if I knew who Carter Watkins was. I replied that he was Amanda Duboise Watkins' husband. My friend said yes, but he was also the son of one of Miss Dollie's granddaughters, the girls I had known briefly in childhood. I admit I hadn't thought about them in years, and Miss Dollie has been gone quite some time. Still, I thought a great deal about Carter and his plight after that.

My friend thought that Carter had taken his wife back. I don't know if that is true, and whatever decision he made was his alone and he obviously knows more about the situation than we do. If it's true, it's doubly sad that now his wife Amanda will be gone for ten years. When she returns her daughter will be almost grown.

If Amanda is mentally ill, she should have been allowed to get help. If she isn't mentally ill, I want to ask her, "Was it worth it, Amanda?"

Female Predators: A Pretrial & An Arrest

Pretrial for Kimberly Bynum, the teacher who formerly taught at Vina High School, has been set for March 21st. Bynum was arrested in June of last year for an admitted sexual relationship with a student. Under Alabama law, students who have reached the age of consent are still prohibited from sexual relationships with teachers until they reach 19. If convicted of the Class B Felony, Bynum could face a sentence of 20 years.

Dana LaShanna Myhan Allen, according to WHNT Channel 19, is a wife and mother. According to her Facebook page, she's an employee of Florence OB/Gyn Clinic in West Florence. According to Lauderdale County detectives, she's a second degree rapist who preyed on underage boys at her alma mater Wilson High School.

The daughter of Danny and Connie Myhan, the 38 year-old Allen has been married for 18 years to Russell O'Neal Allen. For several years, Allen has been a volunteer basketball coach at Wilson where all of her alleged victims were students. According to detective Travis Clemmons, the investigation has linked Allen to several students, but only one under the age of consent. Like Bynum, Dana Allen faces a felony charge that could result in a sentence of 20 years.

Deal for Ashley Fawn Greenhill? - Part II

At around 3:00 p.m. on October 17th, Robert D. Lee arrived at the home of Ronald Weems to pick up Amanda Taylor. Ashley Greenhill, aka Ash Lette, was sitting on the front porch with Ron's mother Laquania Welch Weems. In her hand was a hatchet that she began to wave over her head in a threatening manner. Greenhill told Lee that sometime after Taylor arrived at the Moss Avenue home around 1:20, she had attacked Ronald Eugene Weems and was no longer at the residence. Lee, fearful for his safety, left the premises. It's good to know Ashley's Juggalo props can pull double duty.

On November 7th, Ashley Greenhill reported to police that she had overheard several phone conversations in which Weems and Laurel Pruett discussed the murder of Taylor and the subsequent disposition of her body. Greenhill stated she was in fear of her life and had shortly thereafter moved out of the Muscle Shoals home she was sharing with the Weems family. Ronald Weems then made his enigmatic Facebook posting in which he called Greenhill a "roach."

According to Laurel Pruett's confession, Ashley Greenhill and her friend Matthew Richard Fox joined Weems and her in the basement of the Moss Avneue home around 10:30 p.m. on the night of the murder. A friend of Fox, aka Fox Fudoshin, has stated Ashley Greenhill texted Fox and asked for information on the best way to hide a body. Fox had ostensibly never met Weems before that night, and Greenhill was the only link between them. We're going to assume Fox now wishes he had never met Ashley Greenhill.

Other sources have stated that after Greenhill looked at Amanda's corpse, she walked upstairs to smoke weed and take Valium while waiting for the safety of nightfall. Fox's friend and co-worker Luke Stanfield stated he has known Ashley Greenhill for approximately ten years and has never known her to be a truthful person. We may infer Stanfield's opinion is correct since she certainly offered several colorful tales to explain the injuries she and her boyfriend inflicted on her then two year-old son.

Yet, Ashley Fawn Greenhill is not in jail with her friends. We have to ask why. What kind of deal was the Brooks High grad offered? Life isn't fair, and neither is death. The enormity of this gruesome murder is mind boggling. If Greenhill isn't prosecuted for this crime, the would-be model will undoubtedly be prosecuted for something else down the road.

An attorney for Kimberly Bynum appeared in Franklin County court this morning and waived a preliminary hearing during the arraignment process. A pre-trial date for the former Vina High School teacher will be set later this month.

Kimberly Bynum's Long-Term Affair?

The image of Kimberly Bynum pictured after her June arrest is in striking contrast to her Vina High School photos. The Russellville woman will be arraigned in Franklin County Court on January 4th and tried possibly as early as February for her part in a sexual relation with a former student, a relationship that may have been begun as early as three years before school officials took notice, or at least action.

However, considering the delays in the trial of Amanda Watkins, it may be 2013 before preliminary legal wranglings are settled. Bynum, like Watkins, could face 20 years in prison for her affair with the 2011 male graduate. The law under which Bynum is charged was outlined in a bill sponsored in 2010 by Rep. Demetrius Newton (D), of Birmingham.

Newton introduced the bill due to an incident in which a teacher and a 16-year-old student were accused of having a sexual relationship but school officials could take no action against the teacher since the student had reached the age of consent in Alabama. The 2010 law provides that consent is not a defense.

RegionalCare has announced Bryan Lee (pictured) is the new Chief Operating Officer for ECM, not Chief Executive Officer, as announced earlier by WAAY Television in Huntsville. We have to wonder if Lee now questions what he's gotten himself into.

Lee is a graduate of UAB and presumably should know the vagaries of regional politics in the highly competitive world of Alabama hospitals...or at least in the Shoals.

Amanda Watkins to be Tried on Halloween...

Former Sheffield Junior High teacher Amanda Duboise Watkins is scheduled to be tried for second degree rape tomorrow--Halloween. It seems a fitting day for the long awaited trial to begin. Assuming a jury can be struck before Noon tomorrow, the defense may begin its case as early as Tuesday morning, and a verdict by Wednesday or Thursday could be expected.

News reports indicate Watkins is now residing in Franklin County where we're sure Kimberly Bynum is anxiously awaiting the verdict as well. Bynum has yet to be indicted by a Franklin County grand jury on similar charges.

The recent Franklin County grand jury docket didn't include Kimberly Bynum, the Vina teacher arrested last June for having sex with an under-age student. Authorities state Bynum will be on the next docket scheduled before the end of the year.

Recently we've had a large number of inquiries concerning two individuals with high profile arrests in Franklin County. We have been informed today that the grand jury will meet next week, but the list of cases to be presented was not available. We will continue to call and to report in the days to come.

Obviously the charges against Jeremy Shane Hall should be of great interest to everyone. There has been a civil suit already filed against the former Russellville police sergeant. If not indicted or convicted of state charges, Hall could conceivably face Federal charges.

Doesn't William Edwards Deserve More?

William Edwards was 72 years old and lived alone. Authorities know that Claude P. Riddle Sr. struck Edwards at 12:57 a.m. yesterday morning and left the scene. The 50 year old Riddle is a tractor-trailer driver from Russellville. Sources say Riddle lives with his mother Mary Katherine Riddle at 1830 Bailey Lane off County Road 55. Authorities theorize the evidence shows Riddle left the roadway and struck Mr. Edwards in the median.

Why would anyone suggest no charges might be filed? Riddle not only knew he hit someone, he knew the exact time and apparently had lost control of the vehicle when he did so. Mr. Edwards' family deserves more...

We have received several inquiries regarding Kimbery Bynum Garner, the Vina teacher charged with second degree rape, and Sgt. Jeremy Shane Hall, the former Russellville police officer charged with rape and several sex crimes against city jail inmates as well as possibly one other underage person. Neither of these has been indicted. The next Franklin County grand jury is in September, but we have not been able to ascertain if either or both these individuals is on the docket.

Character: Dave Soldo Has It; Kimberly Bynum Doesn't

Good character seems to be a rare commodity these days. At one time attorneys were the usual brunt of jokes about shady character, but teachers must be rapidly closing in on first place. Kimberly Bynum-Garner, a math teacher at Vina, is our sextactular teacher du jour.

Bynum-Garner teaches algebra, trigonometry, geometry, and statistics at Vina High School...or did until arrested for having "deviant sexual intercourse" with a student under the age of 19.

What kind of person is the 29 year-old Bynum-Garner? Here's a brief description in her own words:

I grew up in Birmingham, Alabama where I graduated from Hewitt-Trussville High School. I earned my Bachelor's of Science in Mathematics and Secondary Education from the University of Alabama. I am married to Nathan L. Garner, band director at Hamilton High School. We reside in Hamilton with our children, Ladybird (chocolate lab) and Bandit (ninja cat).

If convicted, Kimberly Bynum-Garner could face 20 years in prison. Sources say her 28 year-old husband, a Hamilton native and one-time drum major at the high school where he now teaches, has already moved on. We wish him the best.

We commented yesterday on Dave Soldo, fabrication manager at National Alabama, who has left the beleaguered rail car company. In that blog we referred to Mr. Soldo as an engineer. We have received this e-mail from Mr. Soldo :

In conclusion I personally feel that NAC will be successful company and this community's support has been the best I have ever seen. I can only hope that this will continue. We will all see that company achieve great things. To all my friends at NAC, Best of luck and I will miss you.
