There's a lot of pond scum out there. Then there are those who are below pond scum--those who make decomp smell good. Jason Dewayne Green falls into that category. Now he's lied to get a new trial.

He's tried to damage the reputations of Billy Underwood and Jeff Bowling. We don't know Bowling. We do know Mr. Underwood and cannot imagine a more competent attorney. There is no way in Hades that Billy gave Green bad advice, but now the citizens of Franklin County will have to pay for a new trial.

Now Shay Ledlow's family will again have to go through the ordeal of reliving her death. We hope Green see's his victim's face in his sleep, but we doubt it. Men like him have no conscience. Lying and stealing are ways of life for them...and so is murder.

Speaking of Franklin County tax dollars at work, no one seems to know where Hershel Dale Graham is. On medical furlough, he doesn't have to report to a probation officer. Really? The smell of decomp permeates Red Bay as well.

There seems to be a great deal of confusion about the ownership of certain stores in the Shoals area. The Big Steve's liquor store in Rogersville has no connection with Lil Steve's chain of mini-marts. For those who wish to boycott Big Steve's, that's your prerogative. Just remember that throwing mud at his older son serves no purpose.

First, Shoalanda hasn't made any plans to murder anyone...well, at least any that she would really carry out. Yet if accused of murder or any other serious crime, she would make a bee-line to Billy Underwood's office. Billy always tells it like it is and he has integrity.

What does Jason Dewayne Green have? An AIS number and a bunk at a medium security prison. 

When Green was free, he ran a junk business with his father. He also stole cars - a nice sideline if you own a place that sells scrap metal. We guess he needed the money to buy the alcohol that fueled his drunken rages against an innocent woman whose only crime was loving and trusting him. 

Of course Green denies killing Shay Ledlow. He claims he only gave her the gun and told her to use it. Did Shay actually kill herself? Forensics proved it was impossible for the shooting to have played out as Green claims. 

Green received some excellent advice from Billy Underwood and took a manslaughter plea, avoiding a life sentence for Felony Murder. For those who may not know, manslaughter is punishable by 10 to 15 years, or up to 20 years if it involves a gun. There is no Correctional Incentive Time (Good Time) on sentences above 15 years.

Now all that information is available online at the Alabama Board of Pardons and Paroles site. It's also something that Mr. Underwood carefully explained to Green, but now Shay Ledlow's murderer is claiming it wasn't adequately explained. He's maintaining that he thought he would do only eight years. The bottom line is that Jason Dewayne Green wants a new trial.  

We're sure that if Shay Ledlow could speak, she would say she wanted to live...but Jason Dewayne Green robbed her of that chance.

Those Tentative Parole Dates

If you check the Alabama Department of Corrections site, you may find a parole date for many of those incarcerated in this state. It seems some of these never come to pass, while others are delayed for unknown reasons.

Jason Dewayne Green of Franklin County is currently serving a 19 year sentence in connection with the death of his girlfriend Shay Ledlow. He was recently denied his second appeal in this case. If Green serves his full term, he will be released in November 2032. He has a tentative parole hearing date of April 1, 2020. Let's hope he remains in the Limestone Correctional Center for 17 more years.

If you missed it, Jason Dewayne Green was sentenced earlier today to 19 years for the shooting death of Shay Ledlow.

Hershel Graham, the killer of Red Bay husband and father David Andrasik, has finally made it out of the Kilby Infirmary where he had been held for weeks. He is now in general receiving at Kilby and should be transferred to his permanent location soon.

Arc and mental health programs? We support these tax-funded programs 100%, or at least usually do. We realize some funds from city, county, and state revenue are ear-marked and just can't be handed out in any direction. After all, the world also seems to need more plazas with fountains and bell towers (insert Charlie Whitman joke here.)

What would Arc do if funding is cut? We hope it doesn't have to find out, but we also have quite a bone to pick with Murray Townsend, state and local Arc board member. He recently stated:

The mental health funding rates have increased by 4 percent in the past 15 years, while in the same time period the rate of inflation has been 41 percent.

Really? 41%? Just how did you come up with that figure, Mr. Townsend? We're going to say that after checking, the highest rate mentioned by any watchdog site was 36%. That was somewhat higher than we had anticipated. So, Townsend just fudged by 5%? Or is Arc not getting enough bang for its buck. Plus, the 36% is an average that includes everything from a gallon of milk to a Cadillac to a McMansion. 

In other words, some items purchased by Arc might have even gone down in price over the last 15 years; in fact these staples would not be subject to the same inflation found in the automotive or construction world. Not only that, the rate of inflation also includes precious metals; we sincerely hope that Arc is not indulging in those purchases.

Update on Jason Dewayne Green Sentencing

Looking at two domestic violence deaths today, let's start with Jason Dewayne Green. His sentencing is to be April 7th. Green, by reason of his plea, cannot be sentenced to more than 19 years and 364 days--in other words, just one day short of 20 years. Green anticipates more correctional incentive time, we're told; however, all laws we've found indicate that 15 years is the plateau that excludes CIT.

Judge Terry Dempsey may offer Green a much shorter sentence; his track record is certainly sketchy in such cases. Green may also hope for early parole. Remember, just signing a deal for a sentence doesn't mean he cannot ask for parole or other considerations.

We understand that Kimberly Johnson had three sons (we had reported two yesterday). Our sincere sympathies to all her family.

We have always been told that the State of Tennessee is much sterner on murder cases than Alabama. If James Travis Murks had been arrested in Alabama, he would have been charged with Felony Murder. In Tennessee, he's charged with First Degree Murder and eligible for the death penalty or Life Without. Let's hope prosecutors can make this charge stick.

We recently asked a legal eagle friend of ours to clarify the drug trafficking laws in Alabama concerning synthetic drugs which were not originally addressed in the Alabama Code. Since this question was asked specifically about the major drug bust which included John Wesley Akin, our friend inferred he was convicted under the "Trafficking Enterprise" act. A reader has questioned this since Akin received a 17 year sentence rather than 25 for his Morgan County trafficking charge.

It will be extremely interesting to see the results of his Lauderdale County case. Was he a "kingpin?" This appellation was given him by the Morgan County authorities who initially arrested him. Our personal take would be more middle management, but we're sure the Morgan cops got a thrill out of using the term kingpin.

Jason Dewayne Green Cops A Plea

Jason Dewayne Green, indicted in the shooting death of his girlfriend Shay Ledlow, has accepted a plea in Franklin County. The plea allowed Green to avoid murder charges; it also allowed him off the hook on four felony theft charges related to his Russellville salvage business.

Green will face Judge Terry Dempsey in 30 to 45 days. Dempsey can sentence Green to as much as 20 years, but we doubt that he will. Let's hope Green has to do more actual time than two years.

We understand the meeting concerning disenfranchising Florence voters in the Lauderdale County superintendent's race was sparsely attended; however, it seemed the consensus was Phillip Pettus' inane bill will not get out of committee. One attendee did want to know whom Pettus was shilling for. We do too.

A reader asked the definition of "drug trafficking." This seems to state it succinctly:

(a) This section shall be known as the "Alabama Drug Trafficking Enterprise Act." For purposes of this section, a person is engaged in a criminal enterprise for the purpose of trafficking in illegal drugs if that person violates any provision of Section 13A-12-231, and such violation is:

(1) Undertaken by such person in concert with five or more other persons with respect to whom such person occupies a position of organizer, a supervisory position, or any other position of management, and

(2) From which such person obtains substantial income or resources.

(b) For purposes of this section, "substantial income" means any amount exceeding the established minimum wage, as established by law.

(c) Any person who engages in a criminal enterprise for the purpose of trafficking in illegal drugs shall be punished as follows:

(1) Upon the first conviction of violation of this section, he shall be sentenced to a mandatory minimum term of imprisonment of 25 calendar years or for any mandatory term of calendar years up to and including life without parole and to a fine of not less than $50,000.00 nor more than $500,000.00.

(2) Upon the second conviction of violation of this section, he must be sentenced to a mandatory term of imprisonment for life without parole and to a fine of not less than $150,000.00 nor more than $1,000,000.00.

(3) In no event shall the term of imprisonment or the amount of fine imposed under this section be less than the corresponding term of imprisonment or fine authorized in Section 13A-12-231, for the underlying violation of that section, including application of the Habitual Felony Offender Act, as determined by the type and amount of the particular illegal drug involved.

(d) The courts of Alabama shall have jurisdiction to enter such restraining orders or prohibitions, or to take such other actions, including the acceptance of satisfactory performance bonds, in connection with any property or other interest subject to forfeiture under Section 20-2-93 as they shall deem proper.

We don't know the specifics in any current local cases. We can say that from previous arrests and trials, it's usual to have these transactions on audio and video tape--more or less a slam dunk unless the accused can produce an evil twin.

It does bring up the case of John Wesley Akin. He's facing trafficking charges in Lauderdale after being convicted in Morgan on similar charges. Does he qualify for "Life Without?" We're guessing he doesn't since he had not been convicted in Morgan before being arrested in Lauderdale. It will be interesting to see if Akin will accept a plea and to learn his ultimate fate.

Trial Date for Jason Dewayne Green

Shay in Happier Times

It's been almost forty-two months since Jason Dewayne Green allegedly shot Shay Ledlow in the home they shared. His Franklin County murder trial has been postponed several times. Now a new trial date has been set for the scrap metal dealer, also accused of auto and metal theft.

Pretrial is set for July, with a trial date of August 18th. There's still no guarantee that the trial will go on as scheduled. Shay's family has had many false hopes during all these months, while Green has been offered house arrest and presumably enjoyed stealthy trips to Tunica.

Green has also enjoyed the company of his family. This blog was criticized by Green's relatives for posting a photo of him with his grandmother at a family gathering. Again, we're crushed that this poor family has been so maltreated. Obviously they anticipated Shay's family slinking away. Expect again. None of her family has forgotten, and no one here has forgotten.

Legal Updates

The attorney for Blake Austin Hines has dropped his motion to seek juvenile offender status for the accused home invader. Hines will be tried for the crimes of robbery and assault in June. Hines, who's currently free on 60K bond, maintains three unknown suspects stole his vehicle to commit the crimes.

The case against former City of Rogersville employees suspected of manipulating funds from municipal court was postponed from the last grand jury in Lauderdale County. It's now scheduled to be presented on February 26th.

Rogersville isn't the only local entity currently having problems with missing money. Let's hope the new sheriff rides into town on a white horse with an accountant close behind.

"FOR A FACT" about Jason Dewayne Green

Jason Dewayne Green of Franklin County is a man in a lot of trouble whether he or his employees want to admit it or not. It's obvious Green doesn't want to admit his alleged crimes; his attorney Billy Underwood will be taking each case to trial separately (of course, the judge may have something to say about that). We would hate to have Green's legal fees.

There does seem to be some question as to just what Green has been charged with--at least according to his employee who wrote this:

You are FOR A FACT lying about the stolen cars. I mean was you around at the time? Was you one of those reporters that was surrounding them like the paparazzi if Miley Cyrus was walking down the street?,,,,, Wait.....there were no reporters , just dumb @#+=:es like you assuming. And I hate to burst your bubble honey but there was no murder. But all of any part of that is none of your business. 

It's not hard to enumerate just what Green is indicted for; let's hope we don't leave any out...

...operating an auto theft facility and 98 counts of no records for secondary metal recycling transactions over $500, all felonies.They also each face 30 counts of no records for secondary metal recycling transactions under $500 and 215 counts of scrap metal records violation. Both charges are misdemeanors.

From the same TimesDaily article: In early September, the Greens were arrested for buying and selling stolen property. Investigators said they found two tractor trailers ­— one reported stolen from Hamilton and the other reported stolen from Daleville — at the Greens’ business. Another vehicle found at the business had an altered vehicle identification number, which is against state law. Authorities said several stolen vehicles have been recovered from the Greens’ business.

Of course, the above doesn't list Jason Green's indictment for Felony Murder in the death of his girlfriend Shay Ledlow. We're guessing Green isn't sweating the auto theft charges that much.

Yes, we here at Shoalanda are obviously lying. At least we're in good company--the TimesDaily, Franklin County Sheriff Shannon Oliver, and the Alabama Bureau of Investigation. As for it being "none of our business?" The last time we checked, any one under indictment was placed there by the citizens of the State of Alabama--that includes all those who write under the banner of Shoalanda.

Criminal Appeals & Appealing Criminals

Attorneys for Hershel Dale Graham presented their arguments for a retrial in Graham's manslaughter conviction last Wednesday. Franklin County Judge Terry Dempsey has taken the matter under advisement and will issue his findings at a later date.

Most initial appeals are never granted. After all, Graham's attorneys are essentially asking that Dempsey find himself or his rulings negligent in some way. If the appeal is denied, Graham's attorneys will then seek the next highest court in their attempt to free their client.

Did we say "free?" Graham is basically still free after being convicted in the shooting death of David Andrasik. If the rotund retired wrestler is as ill as his attorneys have claimed, he may never make it to prison to serve any time.

Several readers have e-mailed us that Jason Green no longer wears an ankle monitor. Green is awaiting trial in Franklin County after being charged two years ago in the murder of Shay Ledlow. If these reports are true, it could be that Green has put up a larger amount of bail in order to have greater freedom in his comings and goings.

No, He Doesn't Get to Go to Gran's Either...

Yesterday we blogged about Jason Green, currently under indictment in Franklin County for Felony Murder and First Degree Theft (as they say in the old T.V. shows "Grand Theft Auto"). Green is supposedly wearing an ankle monitor; he is allowed to go to work, church, medical appointments, and grocery shopping--that's it--nothing more.

We posted a pic of Green at a party; the picture was cropped and did not identify anyone else. Blogging is a great deal like the tale of the father, son, and donkey--whatever you do or say displeases someone. Some readers thought the photo and text were misleading. We're not sure in what way, but here's the uncropped photo:

No, whether Hugh asks him to the mansion or Gran asks him to her birthday party, Green is not allowed to go. His alleged victim Shay Ledlow is not attending any parties, now is she? How about the owners of those stolen cars found at his business? No parties for them either; they're busy working to make up the money they lost to Green and his father.

And Green's gran? Wonder if she's proud of him? She could be; now we're thinking of the old saw about acorns...

Death by Cooling Tower?/Jason Green Update

If you're like us, when you hear the words "cooling tower," you think Brown's Ferry. It was a surprise today to learn that Regency Square Mall has a cooling tower. From Wiki:

An HVAC (heating, ventilating, and air conditioning) cooling tower is used to dispose of ("reject") unwanted heat from a chiller. Water-cooled chillers are normally more energy efficient than air-cooled chillers due to heat rejection to tower water at or near wet-bulb temperatures. Air-cooled chillers must reject heat at the higher dry-bulb temperature, and thus have a lower average reverse-Carnot cycle effectiveness. Large office buildings, hospitals, and schools typically use one or more cooling towers as part of their air conditioning systems.

Remember Jason Green, currently under indictment for the murder of his girlfriend Shay Ledlow? As with Amanda Watkins, there are many rumors that Green, who is legally mandated to wear an ankle monitor, has been roaming the roads of Russellville.

Has he? There are many ways to get around restrictions on travel. We had to go around a train. There was a long detour. We couldn't find our medicine in Franklin County, so we had to go to Colbert. The list can go on.

For those who are concerned...and they should be...just remember, Green will eventually be tried for the heinous crime he's accused of. These extra months of freedom may be extremely troubling to Shay's family, but Green has to know they are numbered. Let's all pray for quick justice.

Harry Wayne Roberts Charged with Rape

Three weeks ago, Harry Wayne Roberts and his wife were listed as wanted individuals, namely as the masterminds of a local theft ring that targeted heavy equipment across northwest Alabama. Today Roberts, 48, has been charged with First Degree Rape in Colbert County.

Roberts and his wife Stacy Elaine Murray, 34, list their primary residence as in Russellville. Murray had reportedly turned herself in to Franklin County authorities, but Roberts had not. If Franklin County still wants Roberts, he's being held in the Colbert County Jail. Considering the newest charges against him, he may wish to stay there rather than return to his wife

We've received several comments, both public and private, on yesterday's blog concerning Autumn Marie Wood. Obviously accusations need to be verified before they are published, but one rumor seems to be in full force. Did someone hand Autumn the knife she used to stab Brooklyn Hollins?

The current account of Autumn searching a kitchen drawer for a weapon hardly makes sense. Surely Brooklyn didn't lie on the kitchen floor patiently waiting for the fight to resume. We're sure these facts will be brought out at the trial in September.

Several readers have also asked if the murder trial of Jason Green started today. A Franklin County judge had scheduled the trial, postponed four times, for June 6th; however, we have no new info on the proceedings. Such trials usually begin on Monday, with the first day being reserved for jury selection. There's a good chance the proceedings have again been postponed. We welcome any input.

The Night Shay Ledlow Died

A source in the Russellville Police Department has brought some interesting facts to our attention. It seems the night Shay Nicole Ledlow died at the home she shared with Jason Dewayne Green, there were other crimes taking place at the salvage yard Green owned along with his father. A vehicle disappeared and firefighters were called to a small fire that was later proved to be arson.

Are these two crimes related to Shay's alleged murder? We have no idea. Obviously it's possible that these events were simply coincidences, but it's highly unlikely.

Shay's family has waited over two years for Green to be brought to trial. Let's hope justice will finally be served.

Anyone Ever Make It to Court in Franklin County?

The trial of former Vina teacher Kimberly Bynum was postponed again. Counting pre-trial delays, we're not sure if this was postponement number six or seven, but her original arrest was in June 2011. For those who have asked, a speedy trial is the right of the defendant, not the state. Still, isn't it better to just go ahead and get it over with? The facts of the case won't magically disappear, or will they? Several readers have suggested Bynum may still marry her former student. Well...perhaps the Franklin County Jail could add a honeymoon suite?

We're also waiting for the murder trials of Hershel Graham and Jason Green. Green's trial has been postponed once and was scheduled for the first week in February. The families of David Andrasik and Shay Ledlow need closure, not more delays. Still, we hope for strong convictions in both these cases; any refusal of a delay could possibly be used in an appeal, and the families do not deserve the stress of yet a second trial.

Trials & Tribulations--We Got 'Em

The trial of Brandon Shane Mundy was scheduled to begin today in Lawrence County; however, the former North Courtland police officer has asked for a delay. The Circuit Court judge's ruling on the request should be made known sometime this morning. Mundy is charged in the 2010 traffic deaths of Gary and Sandra Cox.

Today also marks the start of the Jason Dewayne Green trial for Felony Murder in Franklin County. It's expected to last the entire week, if not longer. Green's defense will maintain his fiancee' Shay Ledlow shot herself. The State maintains that the evidence doesn't back up that claim.

In Colbert County, the trial of Tanisha Tetter Welch will begin this morning at 9:00 a.m. Welch, first cousin to accused murderer Ron Wikkid Weems, is accused of harassing a friend of victim Amanda Taylor's family.

Also in Colbert County, District Attorney Bryce Graham has announced he will present the shooting of Jesse Rainey to the next grand jury. If the shooter should be indicted, authorities will then decide if he will be tried as an adult. Rainey remains in critical condition in Birmingham. Whether the shooter is indicted or not, Rainey's family could, and probably will, sue the person or persons responsible for Jesse's condition. Patients with traumatic brain injuries have a long and expensive road to recovery. Here's hoping young Jesse's path will be swift and he can return home to his family in good health.

In Lauderdale County, Andrew Daniel Scott, aka Hottie Scottie, has again been released from jail. This last ten-day stint was the result of a "failure to obey" the conditions of his bond. We'll have info on his trial or plea bargain as soon as it's available.

Ledlow Family Hopes for Justice This Month

The murder trial of Jason Dewayne Green is expected to begin October 15th in Franklin County. Green is charged with the shooting death of Shay Ledlow with whom he shared a home. Green initially told officers that Shay had committed suicide, but forensics failed to bear that out. He was free on 400K bail when he and his father were arrested for illegal activity at their salvage business.

His bond revoked, Green has remained incarcerated until recently when he was allowed to leave jail on house arrest. Shay Ledlow's family has been understandably upset by Green's release, and hope to see Green convicted for the murder. From Shay's cousin:

I GO TALK WITH HER AT LEAST 3 TIMES A WEEK, I MADE A PROMISE TO HER THAT I WOULD FIGHT TILL THE END TO SEE THAT JUSTICE IS DONE. I PLAN TO BE SITTING ON THE FRONT ROW TO STARE THIS DEVIL IN THE EYE ON COURT DAY. I HOPE THAT EACH TIME HE CLOSES HIS EYES THAT HE SEES HER SMILING FACE AND IT TORMENTS THE HELL OUT OF HIM. Since Green has no previous violent record, the strongest sentence that could be expected for Felony Murder would be Life With the Possibility of Parole. Green's attorney is Billy Underwood of Colbert County.

Jason Green Indicted for Felony Murder

Last Thanksgiving Jason Dewayne Green resided in an upscale home he shared with his 27 year-old girlfriend Shay Nicole Ledlow. This Thanksgiving Green will be sharing his holiday meal with numerous other inmates in the Franklin County Jail where he is currently being held on a revoked bond.

The 36 year-old Green has certainly run afoul of the law this past year, starting last December when he was arrested for domestic violence against his live-in girl friend. By the end of January of this year, Green had been arrested for shooting Ledlow dead in the family room of the home they shared. Green used the ever popular "She was trying to kill herself" defense, but forensics indicated foul play. After his arrest, Green was released on a bond of 400 K, but his freedom was short lived.

In September, Green was spotted by law enforcement while driving a vehicle listed as stolen from another county. Upon interviewing Green, the officers determined him to be under the influence and arrested him on both charges. He was returned to the county jail and his bail revoked.

Upon further investigation into the salvage yard Green ran with his father, other stolen vehicles were identified and recovered. At that time officers stated as many as 100 misdemeanor and felony charges could be levied against Green and his father Travis Green, 61, also of Russellville. The Greens had operated Franklin County Recycling and Salvage near the Tharptown community since 2007.

Travis Green remains free on bond, but a law enforcement officer with the county has stated that could possibly change if new evidence is found. The Green's salvage yard is located on County Road 77 near two lakes. Authorities have theorized at least some of the stolen vehicles may have been stripped and abandoned in one or both the lakes. Travis Green has not yet been indicted and could possibly seek a plea in exchange for testimony at this son's trial.

Shay Ledlow made some bad choices in life. Let's hope the Franklin County jury who hears her case will remember not her mistakes, but the caring and vivacious woman her family has described. Her murder demands justice.

Shay Ledlow/DOC Pays 100K for Legal Services?

This photograph of Shay Nicole Ledlow was taken January 18th. Ten days later the man in the photo, Jason Dewayne Green, allegedly shot Shay in the forehead with a .44 calibre handgun. Now Green, a scrap metal dealer, is free on bond in the cosmetologist's death.

Green contends Ledlow killed herself; not many suicides shoot themselves in the forehead, and Green had been arrested this past December on charges of domestic violence against his live-in girlfriend. Shay's Facebook page listed her favorite quote as: Life is short. Live it to the fullest.

Because of Jason Green, Shay Ledlow's life was all too short. Investigators have said alcohol was involved. Is anyone surprised?

Questions prompted by new state ethics laws concerning the Montgomery law firm of Capell and Howard have brought to light a contract with the Alabama Department of Corrections. It seems that beleaguered department pays a 100K yearly retainer for...well, we're not sure for what.

Does the firm represent the state in inmate filed suits? Does the firm advise on the legality of new DOC policies? 100K is a lot of moolah to most of us. We daresay if the state should be sued over a wrongful death or other major issue, there would be additional fees. Too bad none of this money is going to new prisons or at least renovations of older ones.
