A Second Look at Justin Matthew Green




We've recently had quite an upswing in comments about Justin Matthew Green. Apparently, he was indicted on stronger charges than which he was originally charged. These new comments and e-mails have caused us to take a second look at his case.

First we've been accused of not stating all the facts or of reporting lies. All our info comes from the TimesDaily which we would assume received the report from either a police officer or the indictment itself. Yes, we know, sometimes police officers have been known to either get things mixed up or lie. Yes, really.

We have also been accused of having some inside knowledge of the case. Rest assured, we don't. We have been told that the victim was Green's biological child. Whether this is true or not, we have no idea. If it is true, the two older children could also be Green's.

Let's look at the facts as reported in the TD and consider them logically one by one.

1. Only three other people were in the house when the child died--Green, a four year old, and a five year old.

2. The instrument of death was an electrical cord. No toy for a 13 month old would use an electrical cord; one for an older child might. One of the three, even if innocent of a crime, placed the toy in the crib. If it had been there for some time, Green allowed it to remain.

3. The cord was wrapped around the victim's neck--at least three times. The cord was then pulled tight enough to leave ligature marks and eventually cause death.

Now we have to ask if a 13 month old child could have wrapped the cord around its neck and pulled. Even if it could have, when she lost consciousness, she would have loosened her grip. Could the cord have caught on something? We ask what...assuming the child was in a safe environment to begin with.

Why Green was indicted for only manslaughter, we have no idea. Would he have been indicted at all if there had been evidence that one of the child's siblings or half-siblings had killed the child?

Green is now free on a 10K bond. It's a sad world.

Update on Justin Matthew Green




We have previously published two blogs on Justin Matthew Green: Links

As more information has been made available, we wish to clarify some points and make some further observations:

*  The deceased child, Arabella Claire Green was Justin Green's biological daughter. We've had some readers indicate this makes a difference. Really? He might have killed one of his partner's older two children, but not his own?

* We're not saying our search is definitive, but all accidental strangulation infant deaths we've seen mentioned are of the "hanging" variety. This could be remotely possible in this case if the cord which strangled Arabella was caught on her bed in some manner.

* Does anyone think a 13 month-old child left her crib, picked up this corded toy, then returned to her bed where she wrapped it around her neck at least three times, then managed to catch the cord on her bed?

* After reading the indictment, we assume the district attorney's office felt there wasn't enough evidence to try Green for Capital Murder and expect a conviction. Green's attorney would obviously argue the child's death was due to the actions of one her half-siblings, four and six at the time of her death. It could also be the grand jury simply didn't understand the almost total improbability of a death like this.

* Green is charged with Manslaughter. If his partner (or former partner--we don't know their relationship status) agrees, he almost certainly can plead to something much less.

* Green has at least two separate previous arrests that fall into the theft category. One occurred in 2006 and one in 2009. In other words, Green is a slow learner. We understand desperation, but he obviously had much worse problems. Yet his girlfriend apparently found him acceptable. Did the father of the two older children agree, or had he been fighting for custody? Had DHR already been involved?

* Since Green is out of jail on bond, if he has continued to live with Arabella's mother, she has almost certainly lost custody of her other two children to their father--assuming he wants them. If Green goes free, it may be a long battle for this young woman to reunite with her children.

* We would insert here that all young women should choose their life partners carefully, but why bother? After all love conquers all, right?

Is Justin Matthew Green a Killer?


Often we know we’re preaching to the choir on many issues. Surely all of us, who are even minimally sane, want to protect our children. Then why don’t we?

How many times do we read of a child found dead while in the care of the mother’s boyfriend? And please tell us about this phenomenon...why leave your children in the care of someone younger than you (oh, sure he’s a stud!) and who has absolutely no idea how to take care of a cocker spaniel much less a human child? Why?!!!!!

Let’s look at Justin Matthew Green, all of 25 years of age. He’s been charged in Lauderdale County in the death of one of his girlfriend’s three children (God only knows where the father/s was/were). An electrical cord was...somehow...wrapped three times around the neck of the youngest child, aged 13 months. Did Green do this intentionally?

There were two older children in the home, aged four and five, who could have done the crime in a joking way, not realizing the consequences of their actions. Both young children deny abusing their young sibling.

Now we have to ask another question or two. Do the police actually think one or both of the young children killed their sibling, either intentionally or accidentally? If so, the charge of criminally negligent homicide is appropriate for Green. Psychological help is also indicated for the entire family. Or do authorities think Green intentionally killed the child himself and don’t have the evidence (at least yet) to prove it?

Justin Matthew Green is in all liklihood much more of a killer than Jodey Wayne Waldrop, yet he will one day walk free and live as normal a life as someone of his intelligence/morality can. No one said life is fair, and our judicial system proves it everyday.

We’re going to add a word of warning to young mothers: Sex/Affection is not worth more than the life of your child, or at least it shouldn’t be to any caring, intelligent person. If you can’t take care of a child, don’t have one. Yeah, we know...that last piece of advice is going to go a long way.

Justin Matthew Green...Again


From a reader:

Could you help me to understand why XXXXX is being charged with taking someone's life that was of an age that could have refused to take drugs, then when XXXXX gets caught again with drugs he's locked up until his trial date but Justin Green is being charged with the possible death of an innocent child and he fails a drug test but is turned loose only hours later? I have a grandchild the age this sweet baby girl would be and I don't think at the age her life was taken that she would have been capable of wrapping anything around her little neck tight enough to do harm, but yet a parent who is supposed to protect her can harm her and still be a free man.

Is there one answer to the above question? Perhaps not. Deaths related to drug cases seem to carry stiffer sentences, even though both cases are being prosecuted as manslaughter.

First, we're not sure how long Green remained in jail. It could have been hours or days. We assume he made bail on his latest charge.

The case against Justin Matthew Green is also not as strong as the case in the drug death. Green has reportedly blamed his partner's two young children in the death of his daughter. Authorities hope to prove he was at least negligent in allowing the child to die even if they can't prove Green intentionally wrapped the cord around Arabella's neck.

If Green is convicted, the judge will hopefully take into consideration his two previous arrests and the current infraction, whatever it may have been. A sentence of 20 years would still not be enough, but it may be only 15 since there was no gun involved. Whatever the maximum, let's hope Green goes away for a long time.

After much deliberation, our take on the matter is that there was no ill intent in the drug death. There was a violent intent in the strangulation death of Arabella Green. She didn't deserve the treatment she received from someone who claimed the name of father. We have another name for him, but it would violate our own policy against using vulgarities.

Justin Matthew Green Is a Slimy Bastard!


Our legal system in Alabama dealing with capital crimes is a joke. Today a Limestone County jury found Joel Moyers, albeit quite a mental case, guilty of capital murder. The prosecution proved the SKS rifle was accurate; too bad the jury didn't ask how accurate Moyers' aim was.

Is such a conviction unusual? Not in this state, but it goes both ways.

Remember Shaun Shapley? He strangled his stepdaughter while raping her and got 25 years in Lauderdale County.

How about Ronald Weems? He strangled his victim, dismembered her body, and taunted her family. He got Life With in Colbert.

Then there's Hershel Graham. He even called his victim back onto his property before he shot him. He got only two actual years to serve in Franklin County.

While we doubt justice in any state is perfect, our capital murder statutes are ludicrous.

If you think the above sentences are a travesty, what about killing a helpless infant? Our blogger L. Stone recently asked this:

I wonder if any baby-mommas' boyfriend that kills the child from a previous baby-daddy ever gets life without parole for intentionally killing a child?

Adult victims usually play some part in their fate, but not infants. Let's take another look at Justin Matthew Green. We've previously blogged on Green's indictment for manslaughter in the strangulation death of his toddler daughter. Yet there's one thing we haven't mentioned that seems extremely pertinent.

Green's young child was found with a cord wrapped at least three times around her neck. Green was there, he saw it. Yet he told his church and Facebook friends that the child was strangled when she became entangled in a blanket--a physical impossibility.

Why did Green lie? Why did Green implicate his partner's two children from a previous relationship? A pretty good guess is that he's a slimy bastard who killed his daughter in a fit of anger.

His punishment? He's been indicted for only manslaughter. Let's hope the jury/judge makes sure he does 20 years. It's much better than he deserves.

Our Bad Boys Being Even Badder




We had only this week been asked a question about Jerry Don Crowden, currently doing 20 years in a state department of corrections facility, when we saw this:

A reader has informed us that Lexie Graham of Red Bay passed away last week. Mr. Graham was for years the bankroll behind his son Hershel Dale Graham's legal battle to remain free. If any are wondering, no, Hershel isn't dead yet, even though his legal dream team had secured Judge Terry Dempsey's permission for him to spend his "last days" in Red Bay with this father.

Hershel does remain in the Kilby Prison Infirmary idling away his hours in bed while his victim David Andrasik remains dead. Hershel is scheduled to be released on probation next February; however, now that his father is gone, will he have a home?

Here's a bad boy we've never mentioned before: Jimmy Clyde Brown. Why mention him now? As with most career criminals, Brown's legal trespasses over the years have not only mounted up, they've escalated. Brown's most recent victim was a woman who had the incredibly bad judgment to date him...and almost wound up dead for her lapse in taste. Ladies, beware; his next girlfriend might not leave the relationship still breathing.

Last, we have Justin Matthew Green, currently serving a 12 month community corrections sentence in the death of his toddler daughter. For those who think 24 months in prison is far too light a sentence for a man who killed his daughter in an auto accident, how do you feel about only one year in "community corrections" for a man who was responsible for his daughter's death by strangulation?

The last time we checked in on Green, he had just become a father again last December, and all was bliss in his relationship with the new baby mama, Alas, it seems the young lady in question finally wised up; now she refers to Green as the "sperm donor," a very apt title.

Think this woman who considered Green and their relationship the exception to the rule is stuck with him for the next 21 years? Think again. When the daughter has her first child at the age of 25 or 30, hopefully in the state of matrimony with a loving husband, guess whom this unfortunate woman will probably have to confront. How about even when the daughter is 50 and has a sudden illness? Yes, this misguided young woman will be forced to see Green then as well...assuming he even bothers to show up.


This young woman, who so diligently defended Green when he was under indictment, is now posting articles about sociopaths on her FB page. We hope every woman reading this considers a man's criminal history before entering into a relationship with him, but we're not betting the fireworks show on it.

New Child Abuse Allegations Against Justin Matthew Green


Justin Matthew Green...if you're known by the company you keep, at least three of Green's closest FB friends are abusers of women. Justin is special; he adds children to the mix.

Now he's been accused of being unable to explain bruising on his daughter, you know, the one who's still living. His older daughter being still dead and all. 

There was a time we fervently hoped men like this would grow up and become productive citizens. Now that we've lived over a century or so, we know that's not possible. Now we merely hope they'll move away from the Shoals until they're too infirm to cause any more physical damage.

A friend currently living in Murphreesboro has sent us this: 
As you know we are basically neighbors. There are several people who live here who grew up there. I'd just like to ask for prayers for Murfreesboro;  there have been crisis actor ads posted on craigslist and Facebook for this Saturday. 500$  for jobs to protest the league of the south I believe. The city held a meeting with businesses on the squares and told us to board windows and shut down and prepare like a hurricane was coming. 400 officers are expected with snipers placed. They start in Shelbyville and then Murfreesboro at 1pm.  The mayor publicly condemned the group's actions and residents are nervous this will turn out like North Carolina.

Who's Going to Hire Justin Matthew Green?


So Justin Matthew Green, father to dead child Arabella Green, will spend his 12 months of punishment in community corrections. Who will hire him?

We hate to be harbinger of bad news, but companies actually get federal paybacks for hiring such people, who work for them for minimum wage. Nice, huh?

We would add who will date him, but we already know that.

If any of the public should see Green anywhere other than work during his sentence, be sure to report it. He doesn't deserve any nooners where he can make new babies to torture.

Infants Die in Strangulation Accidents Every Day?


Justin Matthew Green’s new girlfriend has contacted us. We’re happy to make one correction for which she asked. She relates that someone at a church Green attended at the time of his daughter’s death started the tale about blanket strangulation.

Her second statement? Very young children die from strangulation every day. Our answer? No, they don’t.

First, statistics on such deaths usually include suffocation (nose/mouth obstructed) and choking (swallowing an object that won’t go down). Actual strangulation is fairly rare.

It occurs when a child loops a blind cord over its head and pulls downward. It also can occur when a cord/ribbon/etc. is intentionally placed around an infant’s neck and becomes entangled.

It does not occur because a 13 month-old child wraps an electrical cord around her neck three times and then somehow hangs it on a stationery object while still in her crib. Feel free to check the Internet--not one such accident ever reported.

If you need any more damaging facts, the American Academy of Pediatrics has stated a child can’t perform such a maneuver until 15 months of age. We found one incident, thankfully not leading to death, involving a 20 month-old child.

Denial? If Matthew Green is such a great guy, why would he even consider beginning a new relationship with a 20 year prison sentence hanging over his head? Of course, considering our legal system, he may walk. If he doesn’t? Maybe his new girlfriend can hook up with Brady Ann Irons’ latest fella. That trial should be in the very near future.

Wanna hear a funny? We actually feel sorry for poor ol’ Wes having to face his old squeeze now that he’s sober…just not sorry enough to think he shouldn’t face the judicial music.

What Is the “Truth” of the Justin Green Plea Deal?




Our blog on the misdemeanor plea for Justin Matthew Green certainly brought some differing opinions, some new “information,” and some vulgar language. What else is new?

First, vulgar language: Sorry, Justin's “friend who's only a friend,” if you use filthy and vulgar words, it says a lot about you. It also gets you banned. As for “journalism,” no one here has ever claimed any
degrees in journalism, but among those who toil here, we do have some heavy-hitting degrees. Our blog is opinion...we let you offer yours if you can keep it clean, but apparently you can't. Your language doesn't speak well for either you or Green.

Second, for those who said Arabella's maternal family didn't know about the plea, ADA Will Powell says he discussed it with them. Mr. Powell is running for office, so some of these claims may be dirty
pool, but what if the dead child's mother really didn't know?

Miss Cole may contact the judge; she also may offer a victim impact statement at sentencing. We suggest she requests Green isn't allowed into the community corrections program. If Andrew Scott can obtain enough oxycodone to kill a horse, just think what mischief Justin Green could get into.

No work release means no immediate repayment of court fees, etc. by Green, but we believe it's in the community's interest to make sure he remains in a secure lock-up for the duration of his sentence.

Special Report: Justin Matthew Green to Become Father Again




Remember that advocate for Justin Matthew Green who was "just a friend?" Well, she's announced she's knocked up. Wonderful! Of course, he doesn't love her enough to marry her... Maybe when he gets out of work release, or should we say community corrections? Who the heck knows what Lauderdale County will do with him for the next 12 months?

'Tis the Season To Be Grumpy!


Get back, Grumpy Cat. Our readers are not happy either.

From a reader on Muscle Shoals football: Things changed a lot when Scott Basden came on the scene. He pretty well demands center stage and calls the shots. At one time, he sent out a letter to all of us that had reserved seating to inform us that he had doubled the price to $200.00 per seat. When we asked Wooten who authorized that (since the Board is supposed to set fees, etc). Basden his dumb old country bumpkin act and said he thought he was supposed to set the prices for those things since it was his "fundraiser". Things will never change with the people in place as it is now.

From an associate of the Sheffield Police: It appears that one of Sheffield PD's officers is on administrative leave pending possible domestic violence charges being filed.

We've previously mentioned, in fact several times, how different charges are for the same crime depending upon the county, victim, etc. Yet, several studies have been done concerning the physical attractiveness of the alleged criminal.


At left is Jodey Wayne Waldrop of Franklin County who shook his infant son to death. While we have no sympathy for him, we don't believe he intended to kill the infant. He admitted his actions, apologized to his wife for the crime, was convicted of Capital Murder, and died in prison.

At right is Justin Matthew Green of Lauderdale County. Green's young daughter died from a cord being wrapped at least three times around her neck. Green placed the guilt on his partner's two older children and has not apologized, at least publicly. He's now charged with Manslaughter.

Two different counties...and two different looks. Does Green with his blond hair and blue eyes simply appear more innocent because of his baby face? It's something to think about.

Green Gets Only One Year in Daughter's Death?




He said/she said/the kids said! Muddied waters, even with forensic evidence to the contrary, don't make a good case. So now Arabella's mother has accepted a plea from her one-time live-in love, the dead child's biological father.

While not as sad as the child's death, it's disturbing that we the tax payers were charged for extra forensic investigations ordered by Justin Matthew Green's defense. Ideally, Green will one day repay all court costs, but this is never a given.

So high-ranking Chinese Communist official Zing Zang Zung is the only owner of record for what was once Florence Golf & Country Club? And he has “rebuffed” the request of Florence to purchase this parcel for which the he has no actual use now...or ever?

Assuming Robert Palmer of the TimesDaily actually knows what the word “rebuff” means, the Chinese businessman said no in a rude, abrupt manner. Why does that not surprise us?

Zing Zang Zung wanted revenge on the city, so no animal shelter at the old country club. James Bankston and cronies see racial discrimination everywhere, so no animal shelter on Fairground Road?

We say let Bankston pony up the money for a lawsuit. We'll supply the popcorn.

Some Well-Deserved Awards


The “Prince Will Biiiiite You!” Award goes to the Russellville city council which stated they were unsure about passing an animal control law since that might necessitate having to construct an animal shelter or “pound.”

The “You Just Know He's a Shyster” award goes to attorney Chris Childers who claimed Theodore Allen Vaughn had been found innocent of charges against him. If Vaughn was found “innocent,” he would be the first person in U.S. history to have been so. Let's see....does Childers think the pubic is that uneducated or did he sleep through three years of law school?

The “You Gotta Be Kiddin' Us” award is a tie. Shannon Johnson states he's simply misunderstood, and Christy Scott claims she had ineffective council. For those who might not remember, the
Russellville mother's attorney was Robert Tuten of Huntsville—he's almost as good as our friend Billy and costs even more.

The “Really?” award goes to the mother of Arabella Green. After her boyfriend accepted a plea deal allowing him to serve only one year in the death of their daughter, several wrote us that Kayla Cole knew nothing about it. We found that just a little odd. Now, she's a no-show at the sentencing of Justin Matthew Green. In fact, only Arabella's grandmother bothered to write a victim impact statement. BTW, Green says he thinks about the dead child every day. Big of him, isn't it?

Comparing Two Killers


First, we've had a question about the April 28th preliminary hearing for John Clark Burns Jr. in Wayne County. We have not heard the results but will endeavor to find out the next court date.

A reader, "Josh," has asked among other things why we feel Justin Matthew Green is a much more despicable character than Joel Moyers. Green's victim was totally helpless and innocent. Moyers' victim was guilty of public intoxication, public lewdness, and attempting to destroy public property. Yet he should have been left for authorities to handle and in no way deserved to die.

Moyers certainly had some mental problems, but we did laugh at some testimony recently released from a bail hearing. Three male neighbors testified they had found Moyers' recent actions belligerent. One of those testifying was Bronwen Murray's father; he reported that the Belle Mina man had confronted a poacher.

While we would have called authorities on the thief and tried to have gotten a tag number, we doubt that it's too unusual in Limestone County for a rural-raised citizen to confront a thief. When worlds collide...

As for those 1K of Brandon's friends who wanted Moyers convicted of Capital Murder, we don't doubt that. We can remember over 2K wanting Hottie Scottie to take an infant away from its parents. We also remember those who initially felt John Clark Burns Jr. was a victim (hmmm....where did they go when the dust settled?) The opinion of the young, especially when based on misleading information, is often not the opinion of those unconnected to either side.

That brings up the Moyers family. No, Josh, we've never met any of them, communicated with them, or received any money from them.

Now the civil suit: The parents of Brandon Hydrick are suing Joel Moyers. Sorry, don't see any deep pockets there. Does his mother have money? We have no idea, but even if she does, it won't be Moyers' until she leaves this mortal plane...if even then.

It's always amusing to see the aggrieved families rail against a miscreant at a criminal trial, stating they will never be the same, that nothing can make it right, then see the same families suing for millions. Apparently enough money can make at least some of it right.

And the Underwood family's suit against On the Rocks continues...

Finally, we hope everyone sees just how our legal system can be influenced by a man of Parker Griffith's status. Such influence is usually wielded to arrange an early release, not a more serious charge. In either event, it's troubling.

Movers & Shakers...Thieves & Takers


We're still waiting for Justin Matthew Green's new squeeze to tell us why he's such a wonderful guy. Maybe she doesn't know about his theft of property arrest in 2008, not to mention fraudulent use of a credit card. Honey, if you can't do better than this...please think of your children. We know--brick wall. If you feel sorry for him, think about his beautiful daughter who died gasping for breath. Twenty years--no less!

The missing bench from 7-Points? Yes, it was removed at the request of merchants. At least three gentlemen regularly used the bench. One had been banned from McDonald's. One (not sure if same one or not) regularly asked shoppers to drive him one block to Chazz's. We assume the same one would ask for an ambulance when he could no longer walk.

Sad, but the merchant's association felt this was the best way to handle the situation. We see that one of these men now brings his own lawn chair.

We had a reader ask why Ryan Hydrick was not arrested for DUI the night of his brother's death. We're not sure he wasn't, but it is understandable if he was allowed to go home to his parents at a time like that. Will there be an appeal of the Moyers verdict? Certainly.

Remember Keller Hospice? It's been LHC Hospice for some time now. Apparently, hospice is still extremely cut-throat in the area. We'll have more on this later, but it seems LHC is now waiting in the wings to take the patients of a long-time Florence hospice which has lawsuits aplenty filed against it.

Only 40 or 50 Years?


We've commented before on this trend, if after all these years it can be called a trend. It's built-in obsolescence. Buildings are designed to last around 30 years, unless they're a fast food franchise, for which eight to 10 years is a long life. We can understand that thinking in the medical profession, at least to some extent. Yet buildings can be built to be easily remodeled or added on to.

Florence's new animal shelter will be built in sections, pods if you will. So what are we waiting for?

The new hospital? Mayor Mickey Haddock says it should serve Lauderdale County for 40 or 50 years. Really? Our current facility has been added on to more than a paid escort's chest, but the main building is around 70 years old. Let's hope the new hospital is around just as long.

Maybe you don't read too many articles about abused children, especially infants. It's not fun reading, is it? Who does the abuse? Not usually the mother. More often the male in the menage is responsible. More often than not, he's not the infant's biological father. What does it take to make a woman realize when she moves a man into her home, that doesn't automatically make him a caring parent?

The Justin Matthew Green trial is set for October. We understand he bypassed an arraignment. Guess he understood the charges pretty well, huh?

Hard Hitting News?


 

If you read us regularly, you know we're not a news site. We're a blog with our own opinions. Local news is changing very rapidly, and the Shoals area is lucky to have several news outlets which cover situations the TotallyDecatur shuns.

We've just recently linked Shoals News. The content is not copious, but it has hard-hitting original articles. We hope everyone checks out their latest on a recent SNAFU involving the railroad crossing on Montgomery Avenue.

We hear there will be some interesting developments in the Justin Matthew Green manslaughter trial...and they're going to cost Lauderdale tax payers more money.

How nice. Kill a kid and get extra funding. Our legal system at work.

News from the Courier-Journal


Things we learn from reading the Courier Journal:
  1. Logan’s was the nation’s first casual steakhouse (founded 1991). Really? Then all those times we ate at Golden Corral, Western Steer, etc. we were actually enjoying fine formal dining? The mind wobbles.
  1. Mr. Euell White states that the voting majority doesn’t know what “impeached” means. Actually, if it had been a game show question, we would have guessed the majority doesn’t know, but it’s nice to see Mr. White commenting on the state of education in the U.S. He's 100% right as usual.
  1. Regular columnist Cathy has an extremely well-written piece about the pitfalls of promiscuity. I think her error is in not realizing many young women want to have a child for their boyfriends to kill so they in turn will have their fifteen minutes of fame with some sympathy rolled in.


We blogged recently on the death of a 13 month old while in the charge of Justin Matthew Green. Official reports indicated it had at least been considered the two older children could have killed the child. We have to ask if the youngsters, now five and six, are in some sort of state protective custody.

Oh, we’re sure if anyone asked, the answer would be DHR is monitoring the situation. Yep...that goes a long way in Alabama.
