Concerned Citizen 101 Weighs In On UNA Rape Case

We've heard previously from Concerned Citizen 101; now CC101 has some very interesting comments on the Jane Doe/David Dickerson rape case:

It's been awhile since I posted. However, after seeing the latest legal developments at the University of North Alabama (UNA) and the Top Administration's reactions, it's time. While I'm very proud of the community and especially the students and alumni outrage at the very angry, aggressive and borderline bullying statement that UNA recently made concerning the more recent lawsuit filed by Jane Doe. I'm also happy to hear that the students have taken the initiative to plan a peaceful protest on the first day of class which is August 23rd. However, I'm simply disgusted at UNA's position. This statement shows that this President and several members of his EC will do anything to protect its precious reputation. Even cover up mistakes and very illegal activities.

Let's not forget UNA has yet another lawsuit that I told you about much earlier and was finally reported on the front page of the Times Daily on August 4th.

http://www.timesdaily.com/news/local/suit-against-una-alleges-discrimination/article_d583fa3b-e1f4-5d41-b4ea-0d9b0122a509.html

If that wasn't enough, remember my previous blogs listing several others since 2013. And if that wasn't enough. I've been informed that there other EEOC charge notifications filed by employees as well as other possible lawsuits filed by students that Kitts has received that will probably show questionable practices by HR and/or everyone's favorite Vice President, Mr. David Shields and staff that reports to him. And let's get that cleared up. David Shields does not have his doctorate. He's a Mr. Shields, not Dr. Shields.

David P. Shields Jr.
Everyone on social media sites and even on this site are asking the obvious questions. However, the more important question that every taxpayer as well as every parent and student who has paid/will pay tuition to UNA should ask is where is the Board of Trustees (BOT). The BOT is placed at UNA by the Governor of the State. Their sole purpose is the governing control of UNA. While the BOT cannot overstep their bounds and get involved in the day to day activities of the University, as the fiduciary the BOT can and should step in when there are legal matters.

That means unless Kitts and the rest of his Administration have been lying and withholding information from the BOT (which at this point would not surprise me) then the BOT has been aware of these two lawsuits that have made been public, as well as all the other EEOC/OCR charge complaints as well as the all other Federal Lawsuits that UNA has received over the last few years that haven't been made public. And let's get that straight. Just because it didn't make the news doesn't mean there aren't others. I'm just glad these were reported to finally shed a light on what's been going on at UNA for years and both of these cases show just how deep the corruption and cover up is at UNA.

Back to my point. If the BOT has been made aware of these cases then what's their position? Okay one lawsuit...it happens. But allegations of this magnitude and involving Presidents, Vice Presidents, head of HR and audio recordings, pictures and videos? Read the actual lawsuits. And in the lawsuit involving Audrey Mitchell v UNA, the audios and video have been filed with Federal Judge. So no question they exist. (Side note...I hear copies of these recordings exist in other places. If you have access or know who does, let me know. I know Ms. Mitchell does but I don't want to approach her especially since I plan to post these recordings publicly.)

Back to my point. Then the Friday, August 11th published statement that Kitts approved to be posted on the official UNA website. What the heck is the BOT doing as the governing body?!!!! Does Marty Abroms, Joel Anderson, Steve Pierce, Libby Jordan and the rest of the BOT condone these activities? Are their heads buried in the sand? Are they just taking the word of HR, Kitts and David Shields who are named in these lawsuits and complaints? Seriously, does the BOT condone these activities and are they in support of this statement against Jane Doe? Heck Marcus Maples who is a fairly new BOT member is a practicing Attorney. Is this how these BOT members live their personal lives and conduct their personal business and careers?

I think it's past time for the BOT to "govern" and to bring in an outside company to conduct an unbiased investigation into the activities of HR, cases in Student Conduct and Title IX, Mr. Shields, President Kitts, retired President William Cale and Past Interim President John Thornell's activities to start. I have a feeling these will lead to many, many more.

And that brings me to my actual point. Maybe that's why the BOT is so quiet. Fear that things at UNA from Kitts down are truly out of control and an investigation would reveal years and years of questionable practices, lack of internal/operational controls and outright illegal activities that they would now be liable to address. It would also reveal to the Governor that this group of BOT members have not been conducting the business of the State and living up to their sworn duties for years. So instead they help Kitts and the past president and administration cover up and play politics. According to one of the documents filed in the Mitchell v UNA lawsuit there's an audio where past Vice President Clinton Carter told Ms. Mitchell that she better learn how to play politics as he threatens her about filing complaints. I'm sure everyone recognizes that name. In case you don't read this.

https://www.facebook.com/groups/350375204981651/permalink/1597317146954111/

Somebody pleeeaasssseee get me a copy of these recordings.

It's time out for politics and trying to protect yourself. BOT. It's time to admit you've made mistakes and been too complacent. It's time to step in and take the bull by the horns, get to the root of the problem at UNA and let the chips fall where they may. Meaning start handing out termination letters if the evidence shows these allegations in these two lawsuits are true as well as all the other EEOC/OCR complaints and lawsuits that have not been made public. It's also time to publicly apologize to those whose rights have been violated, step up and make things right instead of continuing to waste taxpayers and student tuition dollars on high price law firms who try to bully and threaten the complainant when you know the allegations are true.

I'm asking the constituents who have a vested interest in UNA and human decency to start calling the BOT members and asking for answers and demanding a change in the current culture at UNA. University of North Alabama Board of Trustees members, my attention is set on each of you. It's crystal clear that Kitts' judgment is way off. I'm watching and waiting to see who you really are. Your next moves within the next few days will be very crucial to the tone and direction of UNA's future as well as your own.

Let's get UNA back on track.

A protest against Kenneth Kitts and David Shields? Will the TD cover it? Let's wait and see. Also, several readers have written to inform that David Shields does not have a doctorate, but will often allow others to believe he does. The board? It hasn't been that long ago that Mr. Sam Pendleton sought to have the entire board replaced.

There are many who seek to obliterate names of those who fought on the losing side of the War of the Secession; however, the name "Stonewall" is coming to mind more and more...

UNA Personnel Situation - Part I

We have a long communication from Concerned Citizen 101. Due to its length, we'll be breaking this down into parts. Some references are to audio files which we have also been sent. We will be attaching them so that you may listen if you wish.

While this is tedious in some cases, it's useful to see exactly how this situation continues to play out at UNA:

Well it is me again. And yes, I am still a Concerned Citizen 101 and I will be until a change comes. And yes, it is about the University of North Alabama.
If you remember my last postings, I wanted to find the audio recordings mentioned in the Mitchell v UNA lawsuit. Well like the good book says if you ask you will receive. It took some time to convince those who had copies of these to give them up but I kept asking. I am persistent! Once I heard them my mouth dropped open but I will let you draw your own opinion.
Before I unleash the recordings, I will start by commenting on the Alabama A&M Head Coach statements made this week during a press conference. Now bear with me the audio recordings tie into this. I have no idea if anything Coach Maynor said are true or not. I do not know if it was just rudeness or racist. Everyone will have their own opinion concerning this. Now I will say the statement but an officer placing his hand on his gun while talking to Alabama A&M coach(es) alarms me and should alarm everyone especially in today’s climate. But there’s no documented irrefutable evidence, yet. Just one man’s word against another.

However, something in UNA’s statement made my eyebrow go up and made me laugh out loud. Real loud. The part where “Our athletic programs – including students, players, coaching staffing, alumni and fans – are held to the highest standards of respectful behavior …” I guess that does not include the rest of the University employees such as UNA Administration and Human Resources. Because what’s on these audio recordings is far from high standards of respectful behavior.

Again, as I said about Coach Maynor, claim of racism is sometimes subjective and depends on your own opinion. But I know retaliation when I see and hear it. I know threats as well as creating hostile work environment all of which are illegal. There is no way the UNA Administration specifically the President as well as Board of Trustee members should be okay with any UNA employee regardless of race being spoken to in this manner. Not just once but repeatedly by some Vice Presidents and Head of Human Resources. These conversations were reported numerous times. I am just livid and confused as to why nothing has been done about this. Okay Okay Listen for yourselves.

First up is everyone’s favorite HR person Catherine White. Play attachment labeled.

2016-09-14 Catherine threat about consultant - https://drive.google.com/drive/folders/1er2H-3cCpND65zGGltaiV3brmol8hfO3

Is UNA Board of Trustees okay with Human Resources speaking to employees in this manner? Notice I did not say President Kitts because I think these are his words. Catherine White was just stupid enough to say them. She is still at fault because by position she knows better. Either way WOW.
Now here is how Ms. Mitchell was informed of this meeting. These emails are on the UNA server.

Return to UNA Hijinks

From Concerned Citizen 101....

However, after my findings this past week I’m changing my name to Deeply Disturbed Citizen. Had lunch with some friends and the topics of discussion were very interesting. You guessed it none other than the current happenings at the University of North Alabama. These facts are easily verified.

So it seems that the violation of Ms. Audrey Mitchell’s civil rights continues. If you recall Ms. Mitchell is suing the University of North Alabama.

http://www.timesdaily.com/news/local/suit-against-una-alleges-discrimination/article_d583fa3b-e1f4-5d41-b4ea-0d9b0122a509.html

Well it seems that if forcing Ms. Mitchell’s office area back under Student Affairs Vice President David Shields supervision wasn’t enough, Dr. Kimberly Greenway (previous Director of Student Conduct but received a promotion to newly created position Executive Director of Housing and Residence Life) came up with the bright idea of forcing Ms. Mitchell to have an office right next to Kevin Jacques. Now keep in mind David Shields and Kevin Jacques have starring roles in the Mitchell v University of North Alabama lawsuit. Also, keep in mind Dr. Greenway’s position on campus was Director of Student Conduct. If anybody should know this is a classic case of intentionally creating a hostile work environment as well as retaliation Dr. Greenway should. However, when Ms. Mitchell stated to Dr. Greenway that she refused to be placed in a hostile work environment by being forced to have her office right next to Kevin Jacques, Dr. Greenway didn’t try to come up with another plan instead she told her she would have Human Resources investigate how doing this would create a hostile work environment. Are you kidding me? If this is any indication of Dr. Greenway’s judicial judgement then all of her judicial cases should be reviewed. Allegedly Ms. Mitchell has audio recordings of these interactions.

Let me continue because it gets much worse. So, I was told around the last week of July 2017 Ms. Mitchell received an email from none other than everyone’s favorite and very competent HR person, Catherine White. Catherine included Kimberly Greenway and Evan Thornton (VP of Business and Financial Affairs and Catherine’s boss) on the email. The email stated that Dr. Greenway informed Catherine White of Ms. Mitchell’s claims of hostile work environment if Kevin Jacques’ office was placed right next to hers. Catherine White then stated that Ms. Mitchell was to write a statement showing how Dr. Greenway’s plan for her and Kevin Jacques’ office placement would create a hostile work environment and she would investigated it.

I’ll wait until you stop laughing.

How in the heck (I wanted to use a different word) can Catherine White perform an unbiased investigation on anything concerning Ms. Audrey Mitchell? Keep in mind Catherine White also has a starring role in the Mitchell v University of North Alabama lawsuit. Now given Catherine White’s position she definitely should know better and immediately realized that what Kimberly Greenway was trying to do was a violation of federal law. She should also know that she couldn’t investigate anything concerning Audrey Mitchell and should have never sent Ms. Mitchell an email. If this is any indication of the judgement process she uses when conducting her HR responsibilities then all her cases should be reviewed as well.

Now I’m told Ms. Mitchell responded to Catherine White’s request and pretty much told her some of what I said and much much more. I’m told it was very professionally and respectfully written but a drop the mic kind of email.

Well here is why I’ve gone from Concerned Citizen to Deeply Disturbed Citizen. I’m told Ms. Mitchell responded to the email on July 27th. I’m also told that she included Kimberly Greenway and Evan Thornton in her response. Then on Friday, July 28th, Ms. Mitchell attended a scheduled meeting with Kimberly Greenway and Kevin Jacques but was blindsided and told that she would be removed from her Director of Housing (job title name was changed when she was forced back under David Shields’ supervision) position and forced to either accept a new position, resign or be terminated. Keep in mind that Dr. Greenway couldn’t tell Ms. Mitchell what the new position was because apparently it hadn’t been created yet. But Ms. Mitchell was told she had to give Kimberly Greenway an answer by Monday, July 31st. Who in the heck (not what I wanted to say) expects someone to make a decision about a job they don’t have details on. I’m told this meeting was recorded as well. Way to go Ms. Mitchell!! Also, keep in mind Kimberly Greenway’s previous position was Director of Student Conduct. Wow!!

Now Kevin Jacques was removed from his position as well but it’s not the same circumstances as Ms. Mitchell. He was moved to an existing position Director of University Events, knew where his new office would be and he actually received more responsibility by having multiple offices under his supervision as well as oversight of multiple budgets. This means he technically hit a promotion. Watching the payroll spending site for the possibility of a raise. I’m told that Ms. Mitchell didn’t know where her new office would be nor have a job description until a couple of days before she was suppose to move.

Her white counterparts received nice promotions while Ms. Mitchell was stripped of her supervisory and budgetary oversight responsibilities. If you don’t believe me check out the updated organization chart just published dated October 2017 and look at Mr. Bret Jennings’ (Kevin Jacques was moved into his old position) newly created position under Students Affairs Division Executive Director Of Auxiliary Programs and Ms. Jennifer Sutton’s newly created position Director of Housing and Residence Life (I was informed this is part of Ms. Mitchell’s position once they forced her out). Also, look at the payroll for these two. Look at July 2017 payroll and compare it to November 2017 payroll. Both received over $14,000 a year raises. That’s pretty good. A black woman was retaliated against because she took a stand and filed a lawsuit and then voiced her concerns of being subjected to hostile work environment and got demoted and two of her white counterparts benefited by receiving promotions and nice size raises. Way to go Catherine White and Kenneth Kitts.

https://www.una.edu/humanresources/organizational-chart.html

https://www.una.edu/university-spending/

If these allegations are true about Catherine White she should act like she has some resemblance of ethics and admit wrongdoing and resign from her position.

If these allegations are true about Kimberly Greenway she should be immediately terminated. Get this. I was told there’s some possible Teachers Retirement System violation concerning her payroll for July 2017 and her retirement date and the start date of her new part time position. However, I want to verify and provide proof before I post about it. Stay tuned I’ve put a call into the State Retirement System.

If these allegations are true about President Kenneth Kitts and he knew and/or approved of these actions by Kimberly Greenway and Catherine White (was told there are audio tapes to prove it) then he should do the good employees of UNA and citizens of Florence a favor and resign.

You see not that it matters but I feel it’s necessary to prove my point. I’m a white female and I see all these incidents as clear cut discrimination, retaliation and intentionally creating a hostile work environment due to race. Also, the people I am hearing these things from are both white and black employees and people in the community but mostly white. I said that because I didn’t want any of your readers to think that only black people are upset and claiming racism. No it’s more white people that are verbalizing their concerns to me.

What this boils down to is Audrey Mitchell is threatening their “way” of doing things. Because she’s brave enough to take a stand and expose the systemic discrimination issues at the University of North Alabama. Because she refuses to get along, because she refuses to tuck her tail, bow down and either shut up or quit the powers that be (Kenneth Kitts, Board of Trustees and Human Resources) will continue to humiliate and pick at her in the hopes of finding her breaking point. Can you imagine the embarrassment, intimidation and humiliation Ms. Mitchell must feel and forced to endure everyday. I don’t know how she does it. God bless this young lady and continue to give her strength.

Well, I’m done sitting by and simply posting my concerns. I’m calling the Governor’s Office on Monday and strongly requesting an independent investigation. Yes, I’m done waiting on the Board of Trustees to do anything. I’m also asking the Governor to look into why the Board is allowing all of this to continue and escalate to this level. I just know by their actions or should I say lack there of there’s some questionable things going on with the Board. I will start calling Monday, November 13th and continue to call until I get a response. I’m also asking all of my friends, family and readers to call as well. If you can’t call then write. This is the only way to put a stop to this level of egregious violations.

Governor Kay Ivey
600 Dexter Avenue
Montgomery, AL 36130
334.242.7100

Don’t think for a minute this is just about Audrey Mitchell. Audrey Mitchell is being taught a lesson and by publicly humiliating and continually treat her in such a harsh manner Kenneth Kitts, Catherine White and the rest of the powers that be are sending a very strong message to all of their employees which is sit down, shut up or you will get what Audrey Mitchell is getting. Again Ms. Mitchell is threatening their way of doing business and they can’t afford to lose control of their corrupt empire. That’s why they are digging their heels in.

If Kenneth Kitts, Catherine White, David Shields and the rest of the people involved directly or indirectly in these allegations get away with this it will affect more than just her. They will continue and do it to others and it will/could soon be you. Probably has already happened to you but you’re too scared to speak out and who can blame you.

Start calling!!!!

Sincere apologies to Concerned Citizen 101 for the delay in publishing this post. Also our sincere thanks, for without such telling accounts, most of us would have only the TD's cheerleading articles from which to glean information about the university.

Huge Backlash Against Kenneth Kitts & David Shields?

From Concerned Citizen 101:

Just when you thought it couldn't get much worse... well you haven't been following the actions of the current Administration at the University of North Alabama. With this group it could get worse and has.

So what about the Saturday, August 12th updated statement from UNA about the Jane Doe lawsuit. First it never happened, then all of a sudden it did happen and UNA investigated, saw that the Professor's actions were wrong and so they fired him. What????

Who are these people? Where in the heck are they getting their advice? How do you post a page long statement on August 11th saying the entire lawsuit is a lie. That Jane Doe is just trying to extort money and tarnish UNA's good name. Then the very next day post an entirely new statement saying this did happen but you investigated properly and followed all procedures and protected Jane Doe. UNA posted this August 12th as if the August 11th statement does not exist.

It's called backpedaling. The public is not stupid. The August 11th attack statement does exist and the only reason you removed it was because of the huge backlash and outrage from the public, students and alumni.

So let's talk about Times Daily. What the heck? Talk about insensitive and downright bad timing. Now we all know UNA asked Jennifer Edwards to do this article. But where are the Times Daily Editors? Are you kidding me "What would we lose if UNA wasn't here"? The question everyone should be asking is what was UNA hoping to gain with this article. Was it supposed to be a threat? Or was it supposed to be smoke and mirrors?

So are you saying that because you create jobs and generate all this revenue for the area we should overlook these lawsuits? We should turn a blind eye to the blatant violations of Title IX, numerous complaints of racial discrimination, bullying tactics and very questionable internal controls. Should we be so grateful to UNA that these illegal actions just don't matter? Really UNA. I see you.

No, Kitts!!! It doesn't work that way. Let me put it into perspective. It's like someone posted on FB under the comments concerning this article. "It would be like saying to a batter woman ... You should be grateful your abusive husband brings home a check." His check doesn't give him the right to break the law and treat his wife any type of way. And UNA creating jobs for people in the community and generating all this revenue doesn't give it the right to break the law then try to cover it up by any means necessary.

This community is tired of this Administration. I don't recall anyone asking UNA to pack up and leave Florence. However, we are asking and demanding an unbiased investigation into these publicly known lawsuits and other complaints that are not publicly known and get rid of any employee that is guilty. Even Kitts. Heck especially Kitts if he's in the least bit involved.

So let's talk about yet another incident that will end up in court if UNA doesn't handle it properly. Given UNA's current track record this will end up in court. I was told today that Dr. Kimberly Greenway who was Director over Student Conduct which includes judicial was involved in a situation where she said some very racially derogatory statements to four African American students who were on dance team. Dr. Greenway ultimately sent the girls to a student conduct board over a video that they posted on social media that a white student on dance team said she found threatening and harsh even though her name was never called and you couldn't prove the video was directed at anyone in particular. The white student said she found the video aggressive. Several people on staff have seen the video and stated it was in no way threatening or aggressive. Some of the statements that Dr. Greenway said to these black students were something like... I don't know what it's like to be a black female thank God. And we will not put up with thuggish behavior. The girls mysteriously didn't make dance team this year.

Here's where bad turned worse. Dr. Greenway supposedly was removed from Student Conduct, but get this. She was made Executive Director and moved to Housing and Residence Life. Sound familiar? It should - that's where Audrey Mitchell, in the Mitchell v UNA lawsuit, now works. Per the Times Daily article and court documents, in February Ms. Mitchell was forced to go back under Student Affairs where David Shields is Vice President. Her office, Housing Facilities Management, was forced to join with Residence Life office which is supervised by Dr. Kevin Jacques. Remember that name? You should; he's named all through Ms. Mitchell's lawsuit.

So Kitts and the staff attorney, Amber Fite-Morgan, thought it would be a good idea to force Audrey Mitchell back under the supervision of David Shields and join offices with Kevin Jacques while there is a very heated lawsuit involving Kitts, David Shields, Kevin Jacques and a lists of others. Then if that wasn't bad enough, move Kimberly Greenway out of Student Conduct for stating to students she's glad she's not a black female and make Ms. Mitchell report to her. Who is a black female???!!!

Kimberly supposedly officially retired July 31st but has told several people Kitts is keeping her on payroll to continue working at UNA.

This is the Twilight Zone, right? Who are these people? Can you imagine Ms. Mitchell's treatment now? If Kimberly was removed from Student Conduct because of questionable actions how does she get a promotion to Executive Director? Is Kitts rewarding discriminatory behavior now? Well UNA allegedly allowed a rapist to continue to work out his contract, so I guess anything is fair game at UNA.

Where is the Board of Trustees? It's clear that Kitts is not capable of running a University.

I agree it's time to drain the swamp but add Dr. Kimberly Greenway to the list. If an ounce of this is true she should be fired immediately. Heck, she retired. Tell her to pack her bag and send her on. Keeping her on payroll just added fuel to the fact that UNA covers up questionable activities and lacks internal controls.

Kitts, David Shields, Kimberly Greenway, Catherine White, who's head of HR, and Kevin Jacques should do UNA as well as the community a favor and have the decency to resign. Let's start calling the Board of Trustees and demand their resignation or termination.

Personnel Problems at UNA - Part I

Part I of our series on personnel problems at the University of North Alabama, with audio attached via YouTube. Thanks to Concerned Citizen for the effort to create this YouTube channel and continuing patience as we experimented with various ways to link the audio. While we don't expect any problems with the attached sound files, if any should arise, please contact us.

Well it is me again. And yes, I am still a Concerned Citizen 101 and I will be until a change comes. And yes, it is about the University of North Alabama.

Where Does Buck Stop? White? Shields? Kitts?

One can hear all sorts of things and usually does. There's practically a pool on whose head will roll at UNA; will it be Catherine White, David Shields, or Kenneth Kitts...or a combination thereof? If we had to guess, at least White should be held accountable for not properly overseeing her human resources department.

Catherine Driskell White
How many other employees at UNA are walking around without a background check? What happens if such checks are now done and something untoward is found on one or more professors? Will UNA have to buy out their contracts?

Concerned Citizen 101 has another great editorial on recent events:

A friend of a friend sent me an email that was sent to all employees from the past and present Shared Governance Executive Committee chairs.  Here’s the statement for you to read for yourself…

From: Infanger, Scott Ryan
Sent: Friday, August 18, 2017 10:45 AM

Subject: SG Chairs statement

In light of the recent news regarding the “Jane Doe” lawsuit against the University of North Alabama, we feel it is necessary to release a statement as the Shared Governance Chairs.

We stand with the faculty, staff and students in declaring our support for the Title IX system that protects all of the members of our community, and we condemn any action by any individual, whether a member of the UNA community or not, that would injure or harm anyone.

Much information has been stirring with allegations of administrative wrongdoing and cover up. We have met with President Kitts and University Counsel Ms. Amber Fite-Morgan, and have been briefed on the university’s response to the lawsuit and the university’s actions against the visiting professor. We are confident that the administration acted in accordance with the Title IX policy and system at UNA in protecting the student and the university as a whole. We are relieved to know that as soon as the university learned about a visiting professor’s alleged misconduct, the administration took swift action to prevent further misconduct, and removed him from campus and banned him from all contact with students.

While it is lamentable that such a situation should arise at any point, especially when it involves the safety and security of our students, we affirm that the Title IX policy and system at UNA works and protects our community.

Because this is a pending lawsuit, specific details on both sides must remain confidential.  We are confident, however, that UNA acted appropriately and did everything possible to protect and help the student.
We support President Kitts and the administration in their leadership.

Sincerely,

Scott R. Infanger
SGEC Chair 2016-2017

Lee G. Renfroe
SGEC Chair 2017-2018

University of North Alabama

The statement stated that these two met with President Kitts and University Attorney Amber Fite-Morgan and they went over the University’s response to the lawsuit and the University’s actions against the visiting Professor. These two go on to say they support Kitts and all involved.

I have my opinion of this statement. Bunch of malarkey and more smoke and mirrors. These two Professors should be ashamed of themselves for allowing themselves to get talked into being a part of the political antics of UNA Administration. The rest of the faculty and staff should demand that the present chair Lee Renfroe be immediately removed especially if she didn’t bother to run this statement by any other employees before signing her name to it. But let me show you why I say that.

While they were meeting with slick Kitts and shady Amber Fite-Morgan did they ask either of them if Jane Doe was in fact diagnosed with PDSD by a UNA Counselor and if her actual withdrawal was academic. If so did everyone’s favorite Vice President con artist David Shields change it. If so, why???? Did either of these Professors ask Kitts and Amber if they investigated the “misconduct” of Dickerson and  found he did violate Title IX and they terminated him why did he continue to remain on payroll until June 2016 receiving a check over $10,000 per month? Check out the spending link https://www.una.edu/University-spending. Per UNA’s second statement on August 12th concerning Jane Doe the incident happened Fall 2015. The lawsuit states the two male students told Jerome Gafford about their pictures as soon as they returned from the trip which was November 2015.

Heck, how long does it take to investigate when you have pictures of “misconduct” and eye witnesses? Is this how they terminate somebody guilty of Title IX? Wow. Did either of these Professors ask Kitts and Amber if Catherine White who is head of Human Resources did a proper background check and if so what were the results of that background check? If not, why not? Did either of these Professors ask Kitts and Amber if an investigation was done? Did anyone bother to take Jane Doe’s statement and report this to the Police? Did either of these Professors ask Kitts and Amber about the first August 11th statement made concerning Jane Doe lawsuit. Who posted the first statement? Is this statement supported by Kitts, Amber and the Board of Trustees? Did they ask what course of action would be taken with whomever released and approved the first statement? Why in the first statement did UNA not admit they were aware of Jane Doe’s allegations but then changed it a day later?

These are a few questions that pop into my mind but certainly should have been asked by the Shared Governance Executive Committee chairs if in fact they seriously went into the meeting wanting to get to the truth. The real truth. If they didn’t ask these questions and much more shame on them.

Just with the questions I asked it shows deliberate cover up by Kitts, David Shields and Catherine White. They couldn’t out right terminate Dickerson because they would have to state why. So they asked him to leave and paid him until his contract ran out. If Jane Doe was recommended by the University Counselor for medical withdrawal and David Shields changed it to academic, why? I’ll tell you. Couldn’t have a paper trail of Jane Doe actually seeking medical attention due to Dickerson. UNA would be liable. This entire situation is to cover up Catherine White’s screw up with the background check. But it shows what lengths this President and all his cronies will go to protect themselves. All of them were too comfortable doing this. What we all should be asking is what else have they been in cahoots covering up.

As I said before Kitts and his Administration have proven they are corrupt and not capable of good judgment and doing the right thing. Heck, why would you trust their word in this? They're named in the lawsuit and will do and say anything to cover their butts. If this lawsuit as well as the other lawsuit Mitchell v UNA proves to be true these are career ending charges for all of them. Do you think they would actually tell the truth at this point? Kitts is making close to $300,000 a year. That’s a lot for him to protect by any means necessary. Who else would hire him, David or Catherine when they get fired. Did the Professors see any documented proof backing up Kitts and Amber’s claims? If not, shame on them for not taking their jobs seriously and doing a half *** meeting/investigation and then sending this official statement out to the employees in order to convince everyone of Kitts' and the rest involved's innocence.

Where is the Board of Trustees? Are they a part of the cover up? It doesn’t take  long to figure out if Kitts and the rest are lying. Looks like the good ole political wheel is still in affect. Let's see if we can find a way to get out of this smelling like a rose.

I have an answer that will make that wheel turn faster and even spin off its axis. The public needs to start calling UNA and all Board members demanding answers and the termination of all involved. Better yet let’s start calling Governor Ivey’s office and demand answers.

Just a random thought… I was in the market for a new car. Guess whose car lot I won’t be going to? Board member Todd Ouellette that’s who. Getting ready to do some comparison shopping for insurance. Guess who’s office I won’t be looking at… Board member Steve Pierce.

Don’t let Kitts and the rest of these people talk you into believing their lies and half truths. Do your own research. Keep the pressure on all of them. Students, organize more protests. Public. let’s rally around them and show up at these peaceful protests. Together we can help UNA get back on track but it's going to take consistent pressure and protests from all of us.

Get Your Tickets to the UNA Follies Here!

First, let us say we have the greatest respect and admiration for many of those who toil at, and even lead, the University of North Alabama. We're sure many who are now deans of various departments began their careers with a simple desire to teach. Now these educators are in positions they wish they were not.

Next, let us say we've been greatly surprised by some of the few who have placed the whims of the university over the needs of Florence's school children. You know who you are; if you have any defense, you may send it here to be published.

Yet, Dr. Kenneth Kitts' desires for a tailgaiting kingdom may be the least of his machinations. We're presenting an article from Concerned Citizen 101 for your reading enjoyment. If you pay taxes in Florence, Lauderdale County, or the state of Alabama, this is your problem. If the university ever got any of your or your parents' money, this is your problem. Read this, think about it, demand answers...

*****

The University of North Alabama has questionable activities going on that should be made public. Your readers can verify all of the following information by going to a very public website that Governor Bentley requires all institutions to have and maintain to publish their spending. Their website is www.una.edu/university-spending.

One of your articles stated that UNA states it has no funding. That is always the reason used when they don't want to pay for something. Especially when it comes to raises for employees. However, some employees are getting paid very well.

If you look at the above mentioned website you will see that Dean Gregory Carnes got paid over $38,000 in the month of January 2017. His normal salary ($19,000 per month) is already high enough. Why was his salary doubled? Was it a bonus? If so, a bonus for what?

Gregory Carnes is the Dean of the College of Business. The Vice President and Provost for the entire University John Thornell is paid almost $17,000 per month. John Thornell is Gregory Carnes direct supervisor and is paid quite a bit less. Your eyebrow up yet?

Keep reading it will be.

Kathy Lewis-Adler filed a lawsuit against UNA on December 9, 2013. You can verify this at Docket.justia.com. Named in the lawsuit of course was UNA but also Kerry Gatlin who was former Dean of the College of Business. Shortly after the lawsuit was filed he stepped down to a teaching position. If you look at the spending in 2013 and earlier you will see that Gatlin made a little over $11,000 per month plus teaching supplement. Gregory Carnes is getting paid significantly higher than that for the same position. The current Deans average around $12,000 per month plus teaching supplements. I guess the Dean of the College of Business requires "a lot" more work than the other Deans do. Who is this guy and what is he doing for the "powers that be".

Kathy Lewis-Adler has not been on campus for quite some time (years). However, if you look at the above mentioned website you will see that she is still getting paid. Is this a payoff/settlement? Are they covering up illegal discrimination activities? Many other payoffs have there been.

Andrew Luna who was Director of Institutional Research was removed from his position and has not been seen on campus since. An interim director has been appointed. This occurred late January 2017 -  early February. There are several reasons going around about why he's not been there. One of the reasons is he was written up last year for not "doing" his job. However, if you look at the above mentioned website you will see he is still getting paid over $8,000 per month. Why would he still be on payroll if he was removed for not doing his job? Why is he still getting paid if he's not coming to work? Heck I would like to be accused of not doing my job, sent home and still make $8,000 per month.

Let's all try to get this deal.

Go to the UNA website and click on the directory. Then type in Amber Fite-Morgan. Look at her title - University Attorney and Chief Diversity Officer. Is this not a direct conflict of interest? How can she adequately and objectively perform both roles? Does she or anyone who reports directly to her investigate harassment/discrimination complaints properly or does she sabotage and try to make them go away. Does she meet with the person that is complaining, get all of their evidence and then if the person decides to file a lawsuit does Amber recuse herself or does she defend the University against the very person she once presented herself to be an ally for? Who's going to file a complaint with the Chief Diversity Officer or anyone who reports to her knowing she is also the University Attorney? No one that's who.

But I think that's exactly what President Kitts intended. You see, if there are no complaints filed with the University there can be no lawsuits. By law you have to file an official complaint to the University and allow them to correct the action. If you don't file a complaint then you cannot file anything with the EEOC or OCR. If you can't file with the EEOC or OCR then you can't file a federal lawsuit in court.

Again, President Kitts strategically planned it like this. If there are no complaints filed then it can be reported that UNA doesn't have any issues with workplace harassment or discrimination.

When Amber Fite-Morgan first was hired she was only the University Attorney. She accepted the Chief Diversity Officer position when Dr. Thomas Calhoun left UNA for a president's position at Chicago State. Shame on Amber for accepting that additional position and violating people's civil rights.

Both eyebrows should be be up now.

It is clear that there is corruption and no institutional controls at UNA. The corruption is at the top with past President William Cale and current President Kitts as well as head of HR Catherine White and all of the cliques attached to them. The question is is the Board of Trustees aware of these issues? You can't tell me that some if not all of the Board is not aware of some of these things. UNA has to disclose lawsuits to the Board. With the number of lawsuits and pending lawsuits that UNA has been involved in one would wonder why they haven't insisted or better yet taken action themselves and cleaned the illegal activities going on to ensure future ones don't happen.

The Governor needs to launch an independent investigation into UNA. All of the complaints that have been filed from students, faculty, and staff need to be reviewed to see if they were handled properly. Especially the ones filed since Amber Fite-Morgan was hired and accepted the Chief Diversity Officer position. All judicial cases need to reviewed involving students, faculty and staff to see if Catherine White (Human Resources) as well as Student Conduct handled them correctly. All spending needs to be reviewed. I promise they will find the same if not more civil right violations and questionable and illegal activities than any other university plastered all over the news.

I will continue to dig until UNA does some significant changes in Administration and practices or I will see to it that their business is on the news all over the land and country. I'm committed to that.

Who will join me?

In the past 30 days we've called upon three local board members/elected officials to resign. We might as well make it four:

Gov. Robert Bentley, you bring shame on Alabama government, its people, and (for what it's worth) the Baptist Church. Won't you at least now shoulder some of the blame of this sad state of affairs of state affairs and resign?

A Take on the Roy Moore Imbroglio - No. One

Take No. One:

Roy Moore and the Largest Jury Trial in American…Particularly Alabama...History

In today’s society trying to remain a Republican and (group) text messages will make you lose your religion.  Don’t get me started on the latter!  This year’s senate election is setting up to be a “humdinger”!  Allegations of sexual assault and/or misconduct dog GOP candidate Roy Moore.  Ironically, the Democratic challenger Doug Jones “approved the message” to feature aspects of the Civil War in a campaign advertisement.  Typically Democrats decry any mention of the Civil War except when they can expound upon negatives to be used to their advantage in crafting the “Northern Narrative” and advancing their social justice perversions.

Again I digress and stray back to the plot of the title of this article.  We are about to witness the largest jury trial in American…and particularly Alabama history.  Legally the statute of limitations has expired preventing criminal charges being presented to a grand jury regarding Moore’s actions.  The evidence and/or “facts” from both the plaintiffs and defendant have been presented to the public.  More evidence and objections will obviously be presented by election day.  The jury of Alabamians will be deliberating whether or not Roy Moore is guilty of the allegations put against him, not whether he is the better candidate.  Whether Roy Moore or Doug Jones closely aligns with the values and policies Alabamians hold dear is not on the ballot this election.  The guilt or innocence of Roy Moore is on the ballot.  While polls conducted the past week are all across the spectrum and would give air traffic controllers a headache trying to keep up with; it is no doubt that most Alabamians would favor a Republican senator.

On the morning of December 12th, a jury of Alabamians will be casting their votes for guilt or innocence.  Unlike most jury trials that normally require a unanimous verdict, this verdict will not have to meet that requirement.  Much has been pontificated publicly that the United States Senate will move to boot Moore from the Senate if elected?  As Judge Andrew Napolitano stated (and I paraphrase):  In order for a United States Senate vote to oust Moore from the Senate the actions warranting such vote would have to be committed during Moore’s official time serving as a United States Senator.  That may be an issue for higher learned legal minds to ponder.

Will Moore face “vigilante justice” and be forced out of the race?  Will the jury of Alabamians find Moore guilty or innocent?  If the jury of Alabamians find him innocent, electing him the next senator from Alabama will the jury’s decision be set aside by the United States Senate, violating the right of the people of Alabama to duly select their representation?  My guess that writing all options on a piece of paper and blindly drawing may be the fairest way to predict what may happen.

Tomorrow we'll have a story about a Lothario at the old Regency Square Mall (all names removed) and an eye-opening update from Concerned Citizen 101. We would still like to hear from anyone who may have had problems with the Colbert tax assessor's office five years ago or more. Comments always welcome.

A UNA Insider Again Speaks

From Concerned Citizen 101:

Well it’s been awhile since I’ve posted about UNA. Not because things have gotten better because believe me they HAVE NOT. I have waited because I like to verify the information before I write something. This will jump around a bit but hold on to your seats you will not believe the magnitude of pure foolishness that is still going on at the University of North Alabama.

If you remember in my last post (http://shoalandaspeaks.blogspot.com/2017/11/return-to-una-hijinks.html) I told you that Ms. Audrey Mitchell was forced out of her position by Kimberly Greenway, Catherine White and President Kenneth Kitts. (See link above) Well I thought that maybe Ms. Mitchell’s new Vice President Mr. Evan Thornton (VP for Business & Financial Affairs) would at least be a good person so that she could finally have some peace. Well I spoke to several employees and people affiliated with UNA and it appears that Mr. Thornton is just as questionable and shady as the rest of the Administration. Heck, I guess that’s why Kitts chose him to replace Mr. Clinton Carter. But I’ll let you make your on conclusions based on the facts.

So it appears that Mr. Thornton was originally hired by Mr. Clinton Carter as Controller in the Business and Financial Affairs Office. I’m told that when he first got there he was very nice and helpful to everyone. When Mr. Carter abruptly left in the summer of 2016 (some say he was terminated by Kitts and escorted off campus) Mr. Evan Thornton (white male) was promoted to interim Vice President. While working in the interim position he worked very closely and depended very heavily on Melissa Williams (black female) to help carry the load of Controller duties such as audits, Board of Trustee reports and all the financials at UNA. During this time, Mr. Thornton even promoted Ms. Williams to Assistant Controller. I’m told Evan often bragged on her in many settings saying Ms. Williams was his right hand and he couldn’t do any of this without her. This went on for about a year.

Finally the Vice President for Business and Financial Affairs position was advertised and Mr. Evan Thornton applied, went through the interview process and received the job. Now that Evan got what he wanted...here’s where the mask comes off and the true colors of Evan Thornton are revealed. I’m told that he did some relocation of people and soon after he got his permanent position he promoted Cindy Conlon (white female) (Remember that name. You should she’s named in the Mitchell v UNA lawsuit) from Assistant Vice President of Procurement to Associate Vice President for Business and Financial Affairs. Here’s the problem. I’m told that Cindy Conlon doesn’t know anything about accounting, financials and couldn’t begin to do anything to help with audits or board reports. But she’s paid very well to supervise the controller and assistant controller positions.

Now that Evan Thornton was officially the new VP his old position of Controller needed to be filled. You would think if Ms. Melissa Williams had stepped up when needed and had been doing the duties of Controller along side Evan Thornton for a year he would promote internally and reward Ms. Williams for helping him in his time of need. Well of course not. It appears that UNA doesn’t reward too many minorities. Heck, he promoted her white counterpart (Cindy Conlon) and she wasn’t in the least bit qualified. I’m told Cindy Conlon’s new position wasn’t advertised externally either. They do for who they want to do for. Well I digress.

So the Controller position is advertised externally and Ms. Williams applies. I’m told that she was selected to receive a phone interview but was not “good enough” to receive an on campus interview. Now comes the suspicious part. I’m told the search committee consisted of Cindy Conlon and everyone’s favorite HR person Catherine White. (Now I know you remember that name. She’s now named in multiple lawsuits and EEOC complaints.) There were other members on the committee but I’m told not one person on the committee had direct knowledge and hands on experience of what a Controller actually does. How did Mr. Evan Thornton approve such a committee? Sound like a sham committee?? Look like funny business going on??? Well because it is.

I’m told the person who was eventually chosen for the position Mr. Mike Nelson doesn’t even have a Masters degree and has never worked in/with Higher Education financials. I’m told Mr. Nelson doesn’t know any of the accounting/financial systems that UNA uses and is NOT familiar with any of the processes. But I’m told that Ms. Williams has been asked by Mr. Evan Thornton to train Mr. Nelson on more than one occasion. Yes, you read that correctly!! The same black female who applied for the position. The same black female who was told by Cindy Conlon and her sham of a search committee that she was not good enough to make it to the final three for an on campus interview was asked to train her new white male boss. Let that marinate for a minute.

If Cindy Conlon was so qualified to be promoted from Assistant Vice President for Procurement (which was only responsible for one small area which was purchasing and had no supervision over the Controller or Assistant Controller and nothing to do with the accounting and financials of the University) to Associate Vice President which the Controller and Assistant Controller would now report to them why would Evan ask Melissa Williams to train her new boss? Just ask Cindy Conlon. Oh I know, she doesn’t know how to do the work!! So, how in the heck could she train him. I’m told Melissa Williams is still doing a lot of the Controller job duties.

Anyone else see this as bull? I sure hope Ms. Williams has or is going to file an EEOC complaint.

There’s something else about Mr. Evan Thornton that I was told that I find quite disturbing. It appears that several people under Mr. Thornton’s supervision has received a speech from him that basically says: UNA is a great place to work and if you don’t like it at UNA you can just leave. He then says something like...if you think you can find something better go try and then let him know because he wants to go and work there to. I’m told that his staff usually hears this when they are voicing concerns about something.

Again just my opinion. But Mr. Evan Thornton is threatening his staff so that they will be too scared to file complaints or voice their opinions and/or concerns. He is also creating a hostile work environment with fear and intimidation. Let’s face it if a Vice President comes to a meeting and stands up or sits there and says to a group of his subordinates if you don’t like UNA you can leave then that could be construed as a threat! From his perspective UNA may be great and that’s fine. But he has to know there are real issues at that University and everyone does not have the same experiences as him. Heck everyone does not receive the same pay (over $170,000 per year) as him. But what Evan Thornton is really saying is if you have issues than you need to leave and that’s just wrong.

What is wrong with these people? How does Evan Thornton think this speech is okay to say to people? Again, I guess that’s why Kenneth Kitts chose him. He thinks like the rest of the Administration. Be very careful Mr. Thornton or you’re going to find yourself named in your very own lawsuit. Especially if he has been dumb enough to give his speech in the presence of Ms. Audrey Mitchell.

After hearing all of this I made the statement “All of the University of North Alabama Administration (Executive Council) needs to be cleaned out. https://www.una.edu/administration/offices-and-administration/executive-council.html

But someone pointed out that maybe not everyone on the Executive Council is questionable. It appears that the new Vice President for Academic Affairs, Dr. Ross Alexander, has been doing a lot of good things and doing a lot of firsts in hiring/promoting qualified minorities since he’s been there. Dr. Eric Kirkman named new Director of Kilby. Dr. Terrence Brown named new founding Director of the School of the Arts. But one can’t help but wonder why now. Is this sincere or smoke and mirrors due to the racial discrimination issues that are becoming public? Time will tell.

Which brings me to my next point which includes both UNA and everyone’s favorite newspaper TimesDaily. I was told and actually heard the recording for myself that someone made when they called the You Said It line at TimesDaily and left the message to be published in the You Said It column of the newspaper. The call was made several weeks ago and to date has been omitted. When you read the exact message that was left you will see why. Here’s the message verbatim.

“If you think that UNA naming a building after its first black student means all is well at UNA you are sadly mistaken. Let's not forget the Mitchell v UNA lawsuit as well as other discriminatory incidents that's have occurred to minorities on that campus. There are letters that were sent to several black pastors and civic leaders in the area that detail these incidents and call for protests. Let's also not forget that the same names keep coming up in these various incidents and lawsuits. This includes President Kitts, Catherine White, Kevin Jacques, David Shields, and Amber Fite-Morgan. The letters demand the university Board of Trustees such as Joel Anderson and Marty Abroms and others stop playing politics and do something about the systemic discrimination on the campus.”

Now how many think this will ever be printed. Mr. Joel Anderson and Mr. Marty Abroms wouldn’t have it and everyone knows TimesDaily only prints the feel good, make UNA look good articles. If the caller had said how great UNA is then that would have found its way in the You Said It column very quickly. Well I’m calling TimesDaily out. I will be writing the editor and asking when I can expect this message to appear in the paper. I was told that supposedly Ms. Sherhonda Allen and some of the writers have already received some emails.

Concerning the letters that were mentioned that were supposedly sent out to black ministers and civic leaders more to come at a later date. I’ve read one of the letters so I know it’s true but I’m waiting on an update on if the black community is organizing an actual protest about the racial discriminatory issues. I’m told they are and all I can say it’s about time. My advice = keep protesting, keep marching, keep calling and asking questions until there’s some real change and all issues resolved and all involved removed. Apply the pressure in a very public way!!

Once I confirm some things I will be sure to write about it.

No matter what you may think of the Four-Way re-entry program in Tuscumbia, here's a kicker for you. A resident of Colbert County reports she called Dr. Larry Stutts, aka Sen. Stutts, about the situation. His advice? Pray for the lives of these men to be changed.

While we believe in the power of prayer, such an answer to a real-world problem just doesn't cut it. Certainly, pray, but let's at least have a contingency plan for any problems that arise out of this "ministry."
