Roadblock to Andrew Davenport Trial?

 



On September 17th, it will be four years since Benjamin Andrew Davenport allegedly shot 26 year-old Amber Streitmatter to death as she stood in her own garage in Muscle Shoals:




Due to various reasons, the Tuscumbia man has not yet come to trial, and that's the basis of a very unusual problem for the Colbert County legal system. At the time of Davenport's arrest, Hal Hughston III was appointed a defense attorney. Now four years later, Hughston will soon be the Colbert County district attorney charged with prosecuting the alleged shooter.

In Capital Murder cases, at least two attorneys usually represent a defendant. Could the trial take place as scheduled with the remaining attorney? Could an assistant district attorney present the prosecution without jeopardizing any possible guilty verdict?

All in all, this will be a very interesting case to follow.
