About the New Muscle Shoals Municipal Prosecutor

 

Bethany Ellison Malone is the new municipal prosecutor for Muscle Shoals. While she lives in that city, she appears to practice in Tuscumbia. Yet this isn't what one of our legal eagle friends found so problematic.

Malone's current husband is new Colbert Circuit Judge Mitchell Hayes. In other words, any case she prosecuted and won that went to a county appeal could not be heard by Hayes. Of course, Kyle Brown is the senior circuit court judge and could presumably hear the appeal, but this would take time away from felony trials involving murder, robbery, rape, etc.

Nevertheless, it appears several wonder how the City of Muscle Shoals chose Malone since her private practice isn't in that town and any appeals of cases would be unusually slowed down in the system.

That being said, still others are questioning why the City's centennial kickoff is being held in Florence. Much more on that later...
